VILLAGE OF RED HOOK RESOLUTION #7 - 2023 DATED: April 10, 2023

A meeting of the Village of Red Hook was convened in public session at the Village Hall, 7467 South Broadway, Red Hook, NY on April 10, 2023. The meeting was called to order by Mayor Smythe and, upon roll being called, the following were present:

RESOLUTION FOR USE OF VIDEOCONFERENCING.

WHEREAS, by passing Chapter 56 of the Laws of 2022 (“Chapter 56”), the New York State Legislature amended Section 103 of the Open Meetings Law; and

WHEREAS, Chapter 56 adds Section 103-a to the Open Meetings Law, permitting the Board of Trustees to authorize its members to attend meetings by videoconferencing under extraordinary circumstances, and ;

WHEREAS, Section 103-a(2)(a) requires the Board of Trustees to adopt a resolution following a public hearing authorizing the limited use of videoconferencing under such circumstances; and

WHEREAS, Section 103-a(2) allows for hybrid meetings by requiring “that a minimum number of members are present to fulfill the public body’s quorum requirement in the same physical location or locations where the public can attend”; and

WHEREAS, Section 103-a(2)(c) requires that members be physically present at any such meeting “unless such member is unable to be physically present at any such meeting location due to extraordinary circumstances .. . including disability, illness, care giving responsibilities, or any other significant or unexpected factor or event which precludes the member’s physical attendance at such meeting”; and

WHEREAS, in accordance with Section 103-a(2)(d), any members attending by video conference must, except during executive session, be “heard, seen and identified, while the meeting is being conducted, including but not limited to any motions, proposals, resolutions, and any other matter formally discussed or voted upon”; and

WHEREAS, Section 103-a(2)(g) requires that any meeting where a member attends by video conference be recorded, posted to the Board of Trustees web page within five business days, and transcribed upon request; and

WHEREAS, Section 103-a(2)(h) requires that members of the public be permitted to attend and participate, if authorized, in any meeting by video conference when a member attends by video conference.

BE IT RESOLVED, that the Board of Trustees authorizes its members who experience an extraordinary circumstance, as described above and further defined by any rules or written procedures later adopted, to attend meetings by video conference: (i) as long as a quorum of the members attend in-person at one or more locations open to the public; (ii) as long as the member can be seen, heard, and identified while the open portion of the meeting is being conducted; and (iii) as otherwise permitted under Chapter 56 of the Laws of 2022; and be it further

RESOLVED, that the Board of Trustees shall create written procedures further governing its use of videoconferencing by its members in compliance with Chapter 56 of the Laws of 2022.

## **VILLAGE OF RED HOOK BOARDRESOLUTION OF# - TRUSTEES2026** ## **DATED: FEBRUARY 9, 2026** ## **RESOLUTION NO.TO ____-2026** ## **A RESOLUTION ESTABLISHING UPDATEDAMEND SEWER SERVICEUSER CHARGESFEES (OPERATIONO&M) AND MAINTENANCEUPDATE USERCAPITAL CHARGES)FEE EDU ASSESSMENTS** WHEREAS, the Village of Red Hook owns and operates a publicly owned treatment works (POTW) and seweragesewer system servingthat propertiesservices withina the Village sewer use area; WHEREAS, Chapter 145portion of the CodeVillage; and WHEREAS, after almost three years of operations, a better estimate of the actual cost to operate and maintain the system has been established; and, WHEREAS, Section 145-116B specifies that normal sewage service charges, or O&M charges, are to be established based on a benefit unit (BU) defined as 150 gallons per day of water consumed, or portion thereof; and, WHEREAS, Section 145-120A states that the sewer charge shall be based on the quantity of water used on or in the property or premises as shown by the records of the Village ofWater RedDepartment; Hookand WHEREAS, providesthe BUs have been adjusted to reflect the most recent 4 billing period water use for each property; and WHEREAS, the imposition,Village billing,also assesses a sewer capital charge to recover debt service and collectionother capital-related costs, which charge is apportioned among benefitted parcels on the basis of sewerEquivalent serviceDwelling chargesUnits (EDUs); and WHEREAS, the Village has reviewed corrected water-consumption data and system infrastructure information (including chargesSTEP tank sizing) and has determined that it is appropriate to (i) update O&M benefit units based on “Benefitrecent Units”water use, and (BUii) revise certain capital-only EDU assessments to better reflect existing improvements; and WHEREAS, Generalthe Municipalupdated Lawschedule §separates 452capital-only authorizesEDU aassessments villagefrom toO&M-only establishbenefit and impose sewer rents by resolutionunits, and providesis that a resolution establishingsummarized and imposingincorporated herein by reference as Exhibit A; and WHEREAS, the updated schedule includes, among other changes, revised capital-only EDU assessments for locations noted on the attached summary chart; and WHEREAS, Section 145-120B states the rate of such sewer rentscharges shall be adoptedestablished onlyfrom time to time by resolution of the Board of Trustees after a public hearing upon five days’ public notice; and WHEREAS, the Village of Red Hook Board of Trustees gave public notice on January 28[th] , 2026 for a public hearing held on February 9[th] , 2026; and WHEREAS, the Village of Red Hook Board of Trustees has determinedduly thatconsidered it is necessary and inall the publiccomments interest to increase sewer service charges to ensure adequate revenues for operation and maintenance (O&M) of the sewerage system; WHEREAS, a public hearing was duly heldmade by the Board of Trustees on ____________, 2026, after at least five (5) days’ public notice, at which time all persons wishing to be heard were heard; ## **. NOW, THEREFORE, BE IT RESOLVED, bythat the Board of Trustees of the Village of Red Hook hereby adopts the following sewer user fees and assessments, Neweffective York,with asthe followsMarch 2026 billing:** ** 1. SewerOperating Service& ChargeMaintenance (O&M/User) Charge).**Sewer The sewer service charge for operation and maintenance is hereby established atFee: $178.00162 per Benefit Unit (BU) per quarter. ** One (1) BU equals 150 gallons per day of water consumption (or portion thereof). 2. Definitions.** For purposes of this Resolution, “Benefit Unit” (BU) shall have the meaningas set forth in ChapterExhibit 145 of the Code of the Village of Red HookA and billed in accordance with the Village’s adopted sewerregular billing policiescycle. 3. Adoption of Updated Schedule: Exhibit A (Updated Sewer Fee Schedule) is hereby approved and procedures. **4. Supersession of Prior Rates.** All prior resolutions, rate schedules, and portions thereof that are inconsistent with this Resolution are hereby superseded to the extent of such inconsistency, effective as of the March 2026 billing. **5. Administration.** The Village Treasurer/Clerk and appropriate Village staff are authorized and directed to take all actions necessary to implement this Resolutionadopted, including updatingthe billing tables, notices, and utility billing statements. **6. Severability.** If any clause, sentence, paragraph, section, or partseparation of thiscapital-only ResolutionEDUs shallfrom beO&M-only adjudgedBUs. 4. invalidCapital-Only byEDU aCorrections: court of competent jurisdiction, such judgment shall not affect, impair, or invalidateper the remainderattached thereof,summary but shall be confined in its operation to the clause, sentence, paragraph, section, or part directly involved in the controversychart. ## **7.EXHIBIT EffectiveA Date.– Updated Sewer Fee Schedule (attached)** This Resolution shall take effect immediately upon adoption.
