WHEREAS clauses: - a project for the Village of Red Hook ADA Pedestrian Improvements in the Village of Red Hook, Dutchess County, PIN 8761.48, (the "Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the qualified costs be borne at the ratio of 80% Federal funds and 20% non-federal funds - the New York State Department of Transportation (NYSDOT) will administer and construct the Project - the Village of Red Hook desiresmay require an enabling local law to advance the Project by makingallow a commitmenttax ofcap 100% of the costs of construction workover-ride for the Projectupcoming orfiscal portionsyear thereof2019-20 - the final version of previous budgets has remained within the requisite tax cap - there may be a need to override the tax cap as Local Law in 2019 RESOLVED clauses: - that the Red Hook Village Board herebywill approvesschedule thea Project -public that the Red Hook Village Board hereby grants NYSDOT permission to directly apply federal and state funds to reimburse costs incurred by NYSDOThearing on the Projecttax cap over-ride law for March 11, 2019 at 7 pm to consider a tax cap override - that the VillageClerk ofwill Redpublish Hook Board hereby agrees that the Village of Red Hook shall be responsible for all costs of the Project which exceed the amount of the federal and non-federal funding awarded to the Village of Red Hook - thatnotice in the eventKingston the costs of the Project exceed the amount of federal and non-federal funding appropriated, the Red Hook Village Board shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Mayor thereof - that the Mayor of the Village of Red Hook be and is hereby authorized to execute all necessary agreements, certifications or reimbursement requests with NYSDOT for Federal Aid/State Aid funding on behalf of the Village of Red Hook in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's funding of the Project costs - that the Village of Red Hook will be responsible for all maintenance of the Project - that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project - this Resolution shall take effect immediatelyFreeman
