RESOLUTION TO GRANT CONDITIONAL SITE PLAN APPROVAL

WHEREAS

  • the applicant, Thomas LeGrand, has submitted an application for site plan approval to build a 2400 sq. ft. 2-story commercial office building with an apartment on a vacant lot located at 3 St. John St., Red Hook NY 12571, Parcel No. 6272-06-389759 (the "Property"), in the General Business ("GB") Zoning District (the "Project")
  • pursuant to Section 200-10B(33) of the Zoning Law, business/professional offices are a permitted use in the GB Zoning District
  • pursuant to Section 200-10C(2) of the Zoning Law, an accessory apartment in a commercial structure is permitted use in the GB Zoning District
  • the Project is depicted on a site plan set entitled "Site Plan Prepared for Thomas Legrand" prepared by Welch Surveying, dated February 29, 2024, last revised April 11, 2025 and architectural elevations entitled, "Proposed Exterior Elevations" prepared by Cummings Engineering, P.C., dated March 23, 2025, last revised August 20, 2025 (together the "Site Plan Set")
  • the applicant has submitted a revised Short Environmental Assessment Form ("EAF") dated February 28, 2024, pursuant to the State Environmental Quality Review Act ("SEQRA")
  • in accordance with SEQRA, the Planning Board is required to determine the classification of the Project
  • pursuant to 6 NYCRR § 617.5(c)(9), construction or expansion of a primary nonresidential structure or facility involving less than 4,000 square feet of gross floor area is a Type II action
  • the Project was referred to the Dutchess County Department of Planning and Development pursuant to Section 239-m of the General Municipal Law, which responded on May 9, 2025, that the Project was a matter of local concern with comments
  • a duly noticed public hearing was opened May 9, 2024, and closed on September 11, 2025, during which all who wished to speak were heard

RESOLVED

  • the Planning Board hereby classifies the Project as a Type II SEQRA action
  • the Planning Board hereby approves the Site Plan and authorizes the Chair, or her authorized designee, to sign the Site Plan after satisfaction of the following conditions: Payment of all fees and escrow. Department of Health approval for the methods of water supply and sewer disposal
  • it shall be a continuing condition of approval that all lighting on the Property shall be downward facing and have a temperature of 3000K or less

Amy Smith Reports for Village Board Meeting: Monday, October 6, 2025 ## **Water Department** The mayor gave the report on the Water Department meeting. I can report on water usage and testing results. H20 Innovations’ report for September water usage shows that the Village used just under 7 million gallons (6,808,646) for a daily average of a little over 250,000 gallons (226,955). Three locations were sampled on September 19, 2025. All three locations were negative for Coliform and E. coli. The free chlorine residual amounts ranged from 1.5 mg/liter to 1.07 mg/liter. ## **Events** The Chamber of Commerce submitted their application for a Halloween costume parade in the Village center on Saturday Oct 25, 1 - 2:15 pm. They meet all requirements put before them and I will schedule a check-in meeting one week ahead of the event to ensure we are all in communication. ## **Grants** The Greenway Compact Grant was the subject of a vote earlier. With Karen’s permission, on behalf of the Village, I contacted Brandee Nelson of TIghe and Bond about the scope of planning work for the proposed grant. Ms Nelson came highly recommended by the County’s Planning Department as a local engineer with expertise in planning pedestrian experiences and improving safety for pedestrians in downtown areas. Tighe and Bond also have a landscape architect as part of their team who would weigh in on the greening of the sidewalk areas. I am looking at funding possibilities to support the signage that is required for the implementation of the School Speed Zone. The Governor’s Traffic Safety Committee is currently the main contender. ## **School Speed Zone** This was also the subject of a vote earlier. The proposed school speed zone includes a NYS highway (199/ W. Market) and also a County highway (79/ Linden Ave), there are multiple letters of support needed to bolster the Village’s petition. I have written to the Red Hook Central School District Superintendent, Janet Warden for a letter of support from the schools. The vote tonight constituted the municipality’s support. I have emailed Robert Ballkind, Commissioner of Public Works to get a letter of support from the County as well. That will complete the supporting materials needed for our petition to get the state’s support.
