VILLAGE OF RED HOOK RESOLUTION # ____ - 2023 DATED: NOVEMBER 13, 2023
A meeting of the Village of Red Hook Board of Trustees was convened in public session at the Village Hall, 7467 South Broadway, Red Hook, New York on November 13, 2023. The meeting was called to order by Mayor Karen Smythe.
RESOLUTION ESTABLISHING A DATE FOR A PUBLIC HEARING REGARDING A LOCAL LAW TO CLARIFY THE PURPOSES AND INTENT OF THE NEIGHBORHOOD MIXED USE DISTRICT
WHEREAS, a proposed form of Local Law D of 2023 entitled “A Local Law to Clarify the Purposes and Intent of the Neighborhood Mixed Use District has been laid on the desks of the Village Trustees (the “Proposed Local Law”); and
WHEREAS , pursuant to Section 239-m of the General Municipal Law, proposed amendments to the Zoning Law must be referred to the Department of Planning and Development for its review and report thereon; and
WHEREAS, a Full Environmental Assessment Form (“EAF”) dated November 13, 2023 has been prepared on behalf of the Board; and
WHEREAS, in accordance with the New York State Environmental Quality Review Act (“SEQRA”), the Board is required to determine the classification of the Proposed Local Law.
NOW THEREFORE BE IT RESOLVED, by the Board as follows:

The adoption of the Proposed Local Law is a Type I action under SEQRA.

The Mayor is authorized to sign page 13 of the EAF.

The Board is the only involved agency under SEQRA.

The Board shall hold a public hearing on December 11, 2023, at 7:00 p.m. at the Village Hall, 7467 South Broadway, Red Hook, New York, to hear all interested parties on said Proposed Local Law; and
-
The Village Clerk is hereby authorized and directed to publish notice of said public hearing in the official newspapers of the Village, on or before November 30, 2023, which is not less than ten calendar days prior to the date of said public hearing.

The Village Clerk is hereby authorized and directed to send a copy of the Proposed Local Law, together with a copy of the EAF, to the Dutchess County Department of Planning and Development for a report and recommendation
thereon pursuant to Section 239-m of the General Municipal Law.

The Village Clerk is hereby authorized and directed to send a copy of the Proposed Local Law to the Planning Board and the Code Enforcement Officer for review with a request that all comments be received on or before the public hearing date.

The Village Clerk is hereby authorized and directed to send a copy of the public hearing notice to the clerks of the adjacent municipalities.

A legal quorum of members of the Village Board was present throughout said meeting, and a legally sufficient number of members (majority of the Village Board) voted in the proper manner for the adoption of the resolution. All other requirements and proceedings under law, said regulations or otherwise incident to said meeting and the adoption of the resolution, including any publication, if required by law, have been duly fulfilled, carried out and otherwise observed.
(4) The seal appearing below constitutes the official seal of the Village and was duly affixed by the undersigned at the time this certificate was signed.
