Authorizing the Mayor to sign easements

Resolution #30-2018 — 2018-11-19

WHEREAS

  • the Village of Red Hook is establishing a municipal sewer system to serve the Village pursuant to Article 14 of the NYS Village Law
  • the Village is seeking to construct the sewer system in phases with the first phase encompassing the general business district and contiguous areas (the "Sewer Project")
  • a map and plan of the permanent Sewer Project, with plans and specifications for sewage treatment, has been prepared by C.T. Male Associates, dated February 15, 2017, last revised May 8, 2017, entitled, "Map, Plan & Report, Village of Red Hook Sewer System" (the Map and Plan")
  • on February 8, 2016, the Village Board adopted a negative declaration, finding that the sewer project as proposed would not result in any significant adverse environmental impacts and that a Draft Environmental Impact Statement would not be prepared
  • the Village has been obtaining easements over private property for installation of Phase 1 of the Sewer Project in accordance with the Map and Plan
  • the Village has received the following partially executed easements, which have been reviewed by the project Engineer and Attorney for completeness: 2, 2V, 3, 4V, 5, 6, 6V, 9, 10V, 21, 41, 44, 55, 64, 69, 73, 74, 81, 83, 92, 97, 106, 111, 117, 123, 124, 125-144 (the "Easements")
  • Jennifer Fier has requested that additional language be added to Easement 83 regarding restoration of the easement premises, which language has been reviewed by the Village Board of Trustees
  • Alleff Main Street Partners has requested that additional language be added to Easement 6 and that an indemnity agreement be executed, which has been reviewed by the Village Board of Trustees

RESOLVED

  • by the Board of Trustees of the Village of Red Hook that the Mayor and Deputy Mayor are hereby authorized to execute the Easements, associated tax filing forms and indemnity agreement and cause the Easements to be recorded in the Office of the Dutchess County Clerk
