A LOCAL LAW PLACING A SIX-MONTH MORATORIUM ON ALL APPLICATIONS AND PERMITS FOR DEMOLITION OF A STRUCTURE OVER 120 SQUARE FEET AND FOR ESTABLISHMENT, EXPANSION OR MODIFICATION OF A MOTOR VEHICLE SERVICE STATION IN THE GB DISTRICT

Resolution #39-2017 — 2017-12-11

WHEREAS

  • a proposed local law entitled, "A local law placing a six-month moratorium on all applications and permits for demolition of a structure over 120 square feet and for establishment, expansion or modification of a motor vehicle service station in the GB District" has been presented to the Village Board
  • the proposed local law constitutes a Type II action for purposes of the State Environmental Quality Review Act pursuant to 6 NYCRR § 617.5(c)(30)
  • a public hearing on the proposed local law had been scheduled for November 13, 2017, but notice was not timely published in the Kingston Daily Freeman
  • on November 13, 2017, a special meeting of the Village of Red Hook was convened in public session at Village Hall, 7467 South Broadway, Red Hook, New York, and the Board adopted a resolution setting December 11, 2017, at 7:00 p.m., as the new date to hold the public hearing and hear all interested parties on said proposed local law
  • on or before December 1, 2017, the Village Clerk published a notice of said public hearing in the official newspaper of said Village, the Kingston Daily Freeman, which is not less than ten days prior to the date of said public hearing
  • on or before December 1, 2017, the Village Clerk provided a written notice of the proposed local law to the Town Clerk of the Town of Red Hook, which is not less than ten days prior to the date of said public hearing
  • the Village Clerk referred the question of the adoption of the proposed local law to the Dutchess County Department of Planning and Development for a report and recommendation thereon pursuant to Section 239-m of the General Municipal Law
  • on November 15, 2017 the Dutchess County Department of Planning and Development responded to the referral, stating that it had no comment and that this was a matter of local concern
  • said public hearing was duly held on December 11, 2017, at said time and place, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof
  • a final form of said proposed local law, to be known as Local Law __ of 2017, is on file with the Village Clerk.

RESOLVED

  • by the Board of Trustees of the Village of Red Hook (by a favorable vote of not less than a majority of all of the members of the Board) the Board hereby adopts said Local Law 4 of 2017, entitled A LOCAL LAW PLACING A SIX-MONTH MORATORIUM ON ALL APPLICATIONS AND PERMITS FOR DEMOLITION OF A STRUCTURE OVER 120 SQUARE FEET AND FOR ESTABLISHMENT, EXPANSION OR MODIFICATION OF A MOTOR VEHICLE SERVICE STATION IN THE GB DISTRICT, in the form attached hereto and made a part of this resolution
  • that the Village Clerk hereby is directed to enter said Local Law in the minutes of this meeting and in the Village Code of the Village of Red Hook, to give due notice of the adoption of said local law to the Secretary of State of New York, and take all other actions as may be required by law.
