Mayor Blundell assisted as Host to open the Planning Board Meeting.
(Note: All Members were visible, with exception of Member Hanson who was audio only)
Chair Pagano opened the September 10, 2020 Planning Board Meeting at 7:05pm.
Chair Pagano took a moment and thanked all health care workers, police, fire, essential Village workers and all employees of our local shops, markets and restaurants and thanked everyone for continuing to follow the CDC guidelines in wearing their masks and maintaining social distancing measures.
Chair Pagano advised meeting is being held in accordance with NYS Executive order 202.1 which Governs the Open Meetings Law and that tonight’s meeting is being held via RingCentral and a transcript will be provided at a later date.

Chair Pagano made a motion to accept and approve the Planning Board minutes dated August 13, 2020.

Steven Appenzeller & Beth Goldberg 19 Linden Avenue Subdivision
Represented by Marie Welch, Welch Land Surveying Tax Parcel ID: 6272-06-384861
Marie Welch said this project is straight forward and advised that all the other lots on Linden Avenue are 2 lots with one fronting on Linden Avenue and the other on Church Street extension. At one time all these lots all went through this type of subdivision to allow for 2 lots. This lot is currently a 1.05 acre lot and the owners
propose to create a division line through the middle of their lot creating a slightly over ½ acre lot; both of them are over 1/2 acre lot and 20,000 square feet minimum required by Zoning; both have frontage on a Municipal Road- Linden Avenue being a County Road and Church St. Ext. being a Village Street; the Engineer, Tom Cummings, has visited the site and done soil tests and they have shot typography of the site so he could submit to the Dutchess County Dept. of Health for sanitary sewage disposal system design, and the Village does have Village water so no need to worry about separation between septic and wells because there are no wells; owner is looking to have a 2 lot subdivision where he has one lot.
Chair Pagano asked if this would need to be sent to Dutchess County for Referral. Marie Welch indicated if within 500 feet from County Road gets referred but feels it would come back as a “matter of local concern”. Secretary Hart advised that subdivisions/lot lines are exempt from County Referral.
Chair Pagano said this is a minor subdivision going from one lot to two.
Chair Pagano asked if the Church St. Ext. will need water hook-up.
Marie said yes. Marie said the only other item needing approval for Church St. Ext. would be from the Highway Department for a driveway permit, which she sees no issue with.
Chair Pagano asked if they were working on Board of Health approval now. Marie Welch said yes. Marie Welch said she does not know if they can submit to the Health Department until they have a preliminary approval from the Planning Board. Chair Pagano said these will be conditions of approval (BOH; water hook and driveway permit). Co-Chair Pearson felt that the map has to be filed in order to get approval on a septic system. Marie Welch said that is not true and if they go to them with a Neg Dec. they will review because there are times when you need BOH approval before filing the map. Co-Chair Pearson said it is not an individual lot yet. Marie said they will need preliminary approval. Co-Chair Pearson said he cannot see them getting anything until it is filed. Marie Welch said the Village may want to make sure that it can be BOH approved before they create a lot because they don’t want an unbuildable lot so that is why it does not have to be filed in order to go to the Health Department. Marie Welch felt there was no issue - soils were good; enough space – she feels the Health Department will not look at it until there is preliminary approval, but they can approve it before it is filed. Co-Chair Pearson said yes it can be looked at but not approved for a septic system until the lot line change has been filed. Marie Welch said that is news to her. Co-Chair Pearson said it has to be an individual lot before they can approve a septic system on it.

Marie Welch said she is asking the BOH for permission to file the map and not presenting BOH approved plans for filing, so that is
fine – she will file the map and they can get BOH approval. Chair Pagano said this approval will be contingent upon BOH approval. Chair Pagano is the Board agreed. Co-Chair Pearson said there will be another meeting. Marie Welch said we have to have a public hearing.
No other comments from the Board.
Co-Chair Pearson asked Marie Welch is Mr. Cummings has already done the perk tests. Marie Welch said yes tests were done and believes he has worked up his design.
Co-Chair Pearson asked if lots were level. Marie Welch said yes.
Co-Chair Pearson asked if pins were set. Marie Welch said outbounds corners are in but have not set the pins on the division line.
Co-Chair Pearson asked if there were any encumbrances on Lot 2. Marie Welch said whatever is on there shows on her map and Marie spoke about a fence for a pool at one time and lines. Co-Chair Pearson said it looks like some of the fences are not on the lines. Marie Welch said right - but those fences belong to the people whose property they are on. Chair Pagano said there were no encroachments here. Co-Chair Pearson said it seem fences are going in and out of the property lines. Marie Welch said she sees no issue and well within reason being considered property line fences.
Co-Chair Pearson asked in the upper corner of Lot 2 – where it indicates McAdams – asking if this was somebody’s driveway on their property. Marie Welch said it is not on, and referenced the pin at the corner of McAdams and said that is right at the corner of McAdams, so that McAdam is on Mr. Dione’s property, and she showed because when she located it she was not sure how close it was because she cannot tell where the lines are when doing boundary work so she located it to make sure and when shooting the corner of McAdam she noticed a pin so no the McAdam
driveway is not encroaching on Appenzeller/Goldberg’s property. Co-Chair Pearson asked if it was a driveway that you back into. Marie Welch said she did not know but can check on that.
Chair Pagano asked about Part I on SEQR where it was indicated it was adjacent to an archeological site. Marie Welch said the program EAF Mapper and this program answered the questions so it could be within 5000 feet of an archeological site, but does not mean this site is an archeological site and said you may have to ask DEC for a ruling on it, but that the other question they answered was whether or not there were endangered species and they said yes for bald eagle; but she said there were no bald eagles nesting on this property so she answered no; and she did not see any archeological artifacts on the site and should have checked no; but the EAF mapper said yes.
Chair Pagano asked Secretary Hart if the Board needed to refer this. Secretary Hart indicated she will look into it SHPO.
Chair Pearson about vegetation on Lot 2. Marie Welch said the bush will be used as a divider and one large tree but nothing bearing on the subdivision.

Chair Pagano said SEQR will be completed next month after hearing back from SHPO. Secretary Hart said this would be a coordinated review now. Chair Pagano said no it is an unlisted action. Secretary Hart said not if referring out to SHPO and the Board would need to classify the action and declare lead agency. Secretary Hart said she will look into this and advise.
Chair Pagano made a motion to set the public hearing for October 8, 2020 at 7:00pm for the Subdivision application of 19 Linden Avenue. Motion seconded by Member Pearson. All in favor. Chair Pagano said let the record show that all members were in approval.
Chair Pagano made a motion to adjourn the September 10, 2020 Planning Board meeting at 7:30pm. Motion seconded by Member Hanson. All in favor. Meeting Adjourned.
