Water System Improvement Project Scope
The Village is authorized to construct various improvements to the Village water system, including PFOA/PFOS removal, water storage upgrades, water system controls upgrades, replacement of certain water mains and lead services, and other related or ancillary work, as described in the report prepared by Delaware Engineering, D.P.C., dated August 2019 and revised November 2021.[7][9][11]
Water System Bond Authorization — Principal Amount
Bonds of the Village in the principal amount of $2,000,000 are authorized to be issued pursuant to the Local Finance Law to finance water system improvements. Any grant funds received or other funds appropriated by the Village shall be applied to reduce the principal amount of bonds or notes issued.[7][9][11]

Water System Bond — General Obligation Pledge
Each bond authorized for water system improvements shall be a general obligation of the Village, payable as to both principal and interest by general tax upon all the taxable real property within the Village. The faith and credit of the Village are irrevocably pledged to the punctual payment of principal and interest.[7][9][11]
Water System Bond — Delegation to Village Treasurer
The powers and duties of the Board of Trustees relative to authorizing bond anticipation notes, prescribing terms, form and contents, sale and issuance of bonds, renewals of bond anticipation notes, and execution of credit enhancement agreements are delegated to the Village Treasurer, the chief fiscal officer of the Village.[7][9][11]

Frontier Services Agreement — Static IP Address
The Mayor is authorized to sign the Frontier Services Agreement to provide a static IP address at the Water Treatment Plant.[12]

WIIA Financing Agreement with NYS EFC
The Mayor is authorized to execute the WIIA Financing Agreement with the New York State Environmental Facilities Corporation.[10]

Water System Project — SEQR Type II Classification
The Village Board finds that the water system project including PFOA/S removal and resiliency upgrades is a Type II Action under SEQR (6 NYCRR Part 617.5) and is not subject to environmental review under Environmental Conservation Law Article 8.[8]

USDA-RD Water and Waste System Grant Agreement
The Water and Waste System Grant Agreement with the US Department of Agriculture Rural Utilities Services is approved.[6]

USDA-RD Form E Budget Update — Legal and Bookkeeping
The original Form E (project budget of $3.8 million, dated July 14, 2014) is updated to insert two legal firms (McCabe and Mack LLC and Rodenhausen/Chale) under the legal budget line and Doris Balacic-Schueing under the bookkeeping/reporting budget line. This update does not increase overall project costs or budget.[5]

Engineer Selection for Water Improvement Project
C.T. Male and Associates was selected as the professional engineer for the Village's water improvement project funded by USDA-RD, following advertisement and review of qualifications from multiple engineering firms.[2]

Well Restoration and Electrical Hookup Authorization
The Village approved reasonable costs for restoration and electrical hookup service to the well. An RFP is to be issued to three vendors, and an annual service contract on the generator is to be established.[1]

Superseded by the October 7, 2024 amendment (footnote 11) which increased the authorized bond amount to $2,000,000. The 2022 amendment had updated the project description to include PFOA/PFOS removal, booster pump station construction, water storage upgrades, water system controls upgrades, and replacement of certain water mains and lead services, while maintaining the $1,800,000 financing authorization.[9]

Superseded by the November 14, 2022 amendment (footnote 9) which updated the project description, and further superseded by the October 7, 2024 amendment (footnote 11) which increased the authorized amount to $2,000,000. Originally authorized $1,800,000 in bonds for installation of a carbon filtration system, reconditioning the elevated water tank on Tower Street, and insertion of a pumping station at the Town/Village inter-connect.[7]

Salisbury Bank Line of Credit — Well #15 Bridge Loan
Superseded by subsequent bond and EFC financing. Authorized a $200,000 commercial line of credit from Salisbury Bank and Trust Company at 1.35% interest to provide interim funding for the Water Improvement Project (Well #15), bridging gaps between Village payments to contractors and reimbursement from Dutchess County Department of Planning (CDBG award reimbursable up to $150,000).[4]

Original Water Facility Bond Authorization — $1,242,000
Superseded by the August 28, 2019 bond resolution (footnote 7). Originally authorized indebtedness by issuance of bonds in the principal amount of $1,242,000 for acquiring, constructing, enlarging, improving, and/or extending the Village water facility pursuant to NYS Local Finance Law.[3]
