Phase 2 WWTP Bond Authorization — Principal Amount
The Village is authorized to issue bonds in a principal amount not to exceed $20,000,000 pursuant to the Local Finance Law (Chapter 33-a) to finance construction of improvements to the Village's wastewater treatment plant (Phase 2), as described in the Delaware Engineering, D.P.C. engineers report dated June 2024.[5]
Phase 2 WWTP Bond — Estimated Maximum Project Cost and Appropriation
The estimated maximum cost of the Phase 2 WWTP project, including preliminary costs, incidental costs, and financing costs, is $20,000,000, and that amount is appropriated for such purpose. Any grant funds or other Village funds received and expended on the project shall reduce the principal amount of bonds or notes issued.[5]
Phase 2 WWTP Bond — Period of Probable Usefulness
The period of probable usefulness of the Phase 2 WWTP improvements, within the limitations of Section 11.00 a. 4 of the Local Finance Law, is forty (40) years.[5]
Phase 2 WWTP Bond — General Obligation Pledge
The bonds and any bond anticipation notes issued in anticipation thereof shall be general obligations of the Village, payable as to both principal and interest by general tax upon all taxable real property within the Village. The faith and credit of the Village are irrevocably pledged to punctual payment of principal and interest.[5]
Phase 2 WWTP Bond — Delegation to Village Treasurer
The powers and duties of the Board of Trustees relative to authorizing bond anticipation notes, prescribing terms, form, and contents, and as to the sale and issuance of bonds and bond anticipation notes, are delegated to the Village Treasurer as chief fiscal officer of the Village.[5]
H2O Innovation Operation & Maintenance — Water and Sewer Operator Appointment
H2O Innovation Operation & Maintenance, LLC is appointed as the Village's Water & Sewer Operator, effective August 1, 2025. The Mayor is authorized to negotiate and sign the contract in consultation with the Village Attorney.[6]
H2O Innovation — Village Attorney Conflict Waiver
The Village Board determined that the Village Attorney's representation of H2O Innovation in a winding-down collection action is unrelated and inconsequential, and the potential conflict is hereby waived.[6]
Vector Security — WWTP Security Panel and Monitoring
The Mayor is authorized to engage Vector Security for security panel installation and a monthly monitoring service plan at both the old and new Wastewater Treatment Plants.[7]
Phase 2 WWTP and STEP Sewer System — Total Estimated Project Cost
The Village authorizes the undertaking of Phase 2 upgrades to the existing WWTP and STEP Sewer System at a total estimated project cost of $19,502,800.00. The project will increase WWTP capacity and provide sewer service to 170 additional properties through an expanded collection system.[8]
WIIA Grant Application — Local Match Obligation
The Village authorizes the obligation of funds necessary to meet any required local match for the WIIA grant application, including but not limited to other state or federal grant funding and/or State Revolving Loan funds.[8]
WIIA Grant Agreement — Authorized Signatory
Mayor Karen Smythe is authorized to execute a Grant Agreement with the NYS Environmental Facilities Corporation and any and all other contracts, documents, and instruments necessary to fulfill the Village's obligations under the Water Infrastructure Improvement Act.[8]
Delaware Engineering Professional Services Agreement — WWTP and STEP Expansion
The Mayor is authorized to sign the Professional Services Agreement with Delaware Engineering for WWTP upgrades and STEP sewer system expansion, contingent on removal of the MBR reference and a requirement for written direction prior to starting different project phases, after review by the Village Attorney.[9]
Bond Counsel Agreement — Hawkins, Delafield & Wood LLP
The Mayor is authorized to sign the Bond Counsel Agreement with Hawkins, Delafield & Wood LLP for the wastewater project after correction of a typographical error.[10]
H2O Innovation Operation and Maintenance Agreement — Amendment No. 1
The Mayor is authorized to execute revised Amendment No. 1 to the existing Operation and Maintenance Agreement with H2O Innovation, updating the agreement to require both parties to collaborate on sewer system operation.[11]

Delaware Engineering was awarded the Engineering Services contract for the Wastewater Expansion Project under RFQ#2024-01, following competitive evaluation of three qualified firms.[4]

Delaware Engineering Annual Consulting Retainer
Delaware Engineering is retained as an annual consultant at a monthly rate of $850.00.[2]
Gregg Stolarik Water and Sewer Systems Appointment
Gregg Stolarik is appointed as the main point of contact with control of software changes for sewer and water systems, working full time at 35 hours per week with a benefit package.[2]

The Mayor was authorized to sign two C3ND operator contracts for water and sewer systems with an end date of May 31, 2022, with deletion of the CPI-linked rate provision. Contracts expired May 31, 2022.[3]

The Village terminated its water department operations contract with C.T. Male effective February 1, 2018. Superseded by subsequent operator appointments.[1]
VRI Environmental Services 4-Month Probationary Contract
The Village entered a 4-month probationary contract with VRI Environmental Services, Inc. effective February 1, 2018, in accordance with VRI's proposal dated January 15, 2018. Contract expired June 1, 2018.[1]
