Dutchess County Sewer Expansion Grant Contract
The Mayor is authorized to execute the contract with Dutchess County associated with a $500,000 grant for sewer expansion.[20]
2025
Delaware Engineering – Wastewater Expansion Engineering Services
Delaware Engineering was awarded the Engineering Services contract for the Wastewater Expansion Project following competitive evaluation under RFQ#2024-01. The Mayor is authorized to sign the Professional Services Agreement with Delaware Engineering for WWTP upgrades and STEP sewer system expansion, contingent on removal of MBR reference and requirement for written direction prior to starting different project phases.[13][19]
Phase 2 WWTP Bond Authorization
The Village is authorized to issue bonds in a principal amount not to exceed $20,000,000 to finance the construction of improvements to the Village's wastewater treatment plant (Phase 2), as described in the engineer's report prepared by Delaware Engineering, D.P.C. dated June 2024. The estimated maximum cost of the project is $20,000,000, and it is expected that grant funds will be received to reduce the principal amount of bonds or notes issued.[16]
Phase 2 WWTP Bond – Period of Probable Usefulness
The period of probable usefulness for the Phase 2 WWTP improvement bonds is forty (40) years, within the limitations of Section 11.00 a. 4 of the Local Finance Law.[16]
Phase 2 WWTP Bond – General Obligation Pledge
The Phase 2 WWTP bonds and any bond anticipation notes issued in anticipation thereof are general obligations of the Village, payable as to both principal and interest by general tax upon all taxable real property within the Village, with the faith and credit of the Village irrevocably pledged to punctual payment.[16]
Phase 2 WWTP Bond – Delegation to Village Treasurer
The powers and duties of the Board of Trustees relative to authorizing bond anticipation notes and prescribing the terms, form, and contents and as to the sale and issuance of the Phase 2 WWTP bonds, including execution of agreements for credit enhancements, are delegated to the Village Treasurer, the chief fiscal officer of the Village.[16]
NYS Empire State Development Grant Agreement – Phase II
The Mayor is authorized to sign the NYS Empire State Development grant agreement to accept potential future funding of approximately $1.98 million for the sewer system expansion Phase II project, subject to a $250 application fee.[17]
WIIA Funding Application – Phase 2 WWTP and STEP Sewer
The Village authorized the undertaking of Phase 2 WWTP and STEP Sewer System upgrades at a total estimated project cost of $19,502,800.00, which will increase WWTP capacity and provide sewer service to 170 additional properties. Mayor Karen Smythe is designated to execute grant agreements and associated documents with the NYS Environmental Facilities Corporation under the Water Infrastructure Improvement Act (WIIA), which may fund up to $25 million or 50% of net eligible project costs.[18]
WIIA Funding – Local Match Obligation
The Village authorized the obligation of funds necessary to meet any required local match for the WIIA grant application, including but not limited to other state or federal grant funding and/or State Revolving Loan funds.[18]
2024
SEQRA Lead Agency Designation – WWTP Upgrade Phase II
The Village Board classified the WWTP upgrade Phase II project as a Type I action under SEQRA and declared its intent to serve as lead agency. The project proposes to increase WWTP treatment capacity from 75,000 gallons per day (gpd) to 300,000 gallons per day (gpd).[14]
Planning Board Lead Agency Consent – Phase II
The Village of Red Hook Planning Board consented to the Village of Red Hook serving as lead agency for the STEP Sewer upgrade – Phase II, and requested to be notified of all SEQR determinations, proceedings, and hearings related to this matter.[15]

Refunding Bond Authorization – Phase 1 Sewer
The Village authorized the refunding of its $3,673,000 Sewer System Improvement Serial Bond-2023 (originally issued August 11, 2023) through the issuance of new refunding bonds in a principal amount not to exceed $3,673,000. Refunding bonds are general obligations of the Village payable by general tax on all taxable real property, with faith and credit irrevocably pledged.[12]

The Village is authorized to issue bonds in the principal amount of $8,500,000 to finance the establishment and construction of the sewer system, including acquisition of an existing privately-owned wastewater treatment plant, expansion of the WWTP, construction of approximately 7,000 linear feet of collection pipes and 7,500 linear feet of lateral pipes, and acquisition of easements. This amended the original June 13, 2016 bond resolution, which had authorized $4,900,000.[5][10]

Phase 1 Sewer Easements Authorization
The Mayor and Deputy Mayor are authorized to execute partially executed easements for the Phase 1 Village Sewer Project and to record them with the Dutchess County Clerk. The Mayor is also authorized to execute a hold harmless agreement with the Parish of St. Christopher and St. Sylvia consistent with sewer easement terms.[8]

Phase 1 Map and Plan
The Map and Plan for the Phase 1 Sewer Project was prepared by C.T. Male Associates, dated February 15, 2017, last revised May 8, 2017, entitled "Map, Plan & Report, Village of Red Hook Sewer System," and was filed in the Office of the Village Clerk on August 25, 2017. Phase II of the sewer project as set forth in the Map and Plan is temporarily deferred.[6][7]

SEQRA Negative Declaration – Phase 1 Sewer
On February 8, 2016, the Village Board adopted a negative declaration finding that the Phase 1 sewer project would not result in any significant adverse environmental impacts and that a Draft Environmental Impact Statement would not be prepared.[6]

SEQRA Lead Agency Designation – Phase 1 Sewer
The Village of Red Hook Board of Trustees declared itself Lead Agency for SEQRA review of the municipal sewer system project (Phase 1) serving approximately 130 properties primarily in the general business district. The project was classified as a Type I action under SEQRA.[4]

A public hearing to obtain public comments on the potential environmental impacts of the WWTP upgrade Phase II project was scheduled for August 5, 2024 at 7 p.m. at Village Hall, Red Hook, NY. This was a time-bounded procedural step that has since passed.[14]

Phase 1 Final Apportionment – Original Cost Basis
The original final apportionment for the Phase 1 sewer project was adopted on March 12, 2018, based on a maximum project cost of $4,900,000.00 funded via a zero percent interest EFC loan. Superseded by the Final Revised Apportionment adopted May 17, 2021, reflecting the increased project cost of $8,500,000.00.[7]

C.T. Male Associates of Latham, NY was selected as the engineering design services provider for the Village of Red Hook Sewer Project following review of three RFQ submissions. Superseded by the award of engineering services to Delaware Engineering (RFQ#2024-01) in April 2024.[3]
