Resolution to Abolish the Office of Village Justice

Resolution #38-2024 — 2024-11-04

WHEREAS

  • pursuant to §3-301(2)(a) of the Village Law of the State of New York, the board of trustees of any village by resolution subject to permissive referendum may abolish the office of Village Justice to take effect upon the expiration of the current term of such office
  • the Board of Trustees has investigated the effectiveness and has considered the financial prudence of abolishing said office and those resultant from the town justices assuming the functions previously performed by the village justices
  • the Board of Trustees finds that the needs of the Village for the prosecution of violations under the Village Code and other matters can be handled effectively by the Town Court

RESOLVED

  • the Office of Village Justice, together with the Acting Village Justice, if any, Court Clerk and all supportive services, be, and the same hereby is, abolished upon the expiration of the current term ending on April 5, 2027
  • this resolution is adopted subject to permissive referendum, and the Village Clerk is hereby authorized and directed to publish and post notice of such adoption in accordance with law
  • this resolution will be effective upon the date of the expiration of the period for the referendum, or upon a referendum vote supporting the abolition of the office of the Village Justice
