VILLAGE OF RED HOOK LOCAL LAW NO. 1 OF THE YEAR 2023
A LOCAL LAW TO PERMIT INTERNALLY ILLUMINATED WINDOW SIGNS IN THE VILLAGE OF RED HOOK
Be it enacted by the Village Board of the Village of Red Hook as follows:
Section 1. Legislative Intent
The sign regulations in the Zoning Law prohibit all internally illuminated signs. It is customary for a business to have a single illuminated window sign to let passersby know that the business is open. The purpose of this local law is to permit non-residential uses to have a single internally illuminated window sign not to exceed 1.5 square feet.
Section 2. Section 200-38A(6) of the Zoning Law, entitled “Signs and billboards: Signs not subject to permit process.” is hereby amended to add a new subsection (e) to read as follows:
§ 200-38A(6)(e). In a business district, notwithstanding the prohibition on internally illuminated signs in A(1)(e) and A(3)(a), one internally illuminated window sign per business not to exceed 1.5 square feet (216 square inches) which is illuminated with a constant intensity, no flashing, intermittent or moving lights, only illuminated during business hours, and further subject to all other limitations in 200-38 including but not limited to the limitation that signage located in a window or door shall not occupy more than 25% of the glazing area of that window or door.
Section 3. Subsection B of Section 200-5 of the Zoning Law, entitled, “Definitions,” is hereby amended adding the following new definition:
Window sign – A sign placed within two feet of glass or other translucent material and clearly meant to communicate with viewers outside the building.
Section 4. Severability
If any part or provision of this Local Law or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgement shall be confined in its operation to the part of provision or application directly involved in the controversy in which judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Local Law or the application thereof to other persons or circumstances, and the Village of Red Hook hereby declares that it would have passed this Local Law or the remainder thereof had such invalid application or invalid provision been apparent.
Section 5.
Effective Date
This Local Law shall take effect immediately upon filing in the office of the Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
