Re: NOTICE OF VIOLATION: Failure to Submit Complete or Acceptable SPDES DMRs Facility: VILLAGE OF REDHOOK WWTP SPDES No: NY0271420 DEC Region: 03
Dear Permittee:
Pursuant to State Pollutant Discharge Elimination System (SPDES) Permit # NY0271420, you are required to routinely submit Discharge Monitoring Reports (DMRs). Your DMRs due for the period ending 12/31/2021 have not been submitted through NetDMR; were incomplete; or have an unacceptable No Data Indicator (NODI) code for use on NYSDEC DMRs.
A DMR may be considered incomplete if required results were not reported; all required sampling was not conducted even if an acceptable NODI code for NYS was used; it was not submitted correctly via NetDMR; or an unacceptable NODI code was used.
The following is a list of the missing or incomplete DMRs or DMRs submitted with unacceptable NODI codes:
001Q 17 Failure to submit the complete/acceptable DMRs is a violation of your SPDES permit, Article of the New York State Environmental Conservation Law (ECL), and Section 750-2.5 of the New York Codes, Rules and Regulations. ECL § 71-1929 provides for civil penalties of up to thirty-seven thousand five-hundred dollars ($37,500) per day per violation, and also allows for injunctive relief. To assist in resolving this matter, you must submit DMRs via NetDMR with data or an acceptable NODI code. We also recommend you email the enclosed NOV Response to the addresses provided within 30 days of the date of this letter as a supplement to your DMR.
. If you have failed to submit complete DMRs within 30 days of the date of this letter, an Order - on Consent (Order) with a penalty will be sent to you concerning any remaining violation(s). Please note use of some acceptable NODI codes may still result in an Order due to incomplete reporting. Once an Order has been sent, there will be no opportunity to settle this matter without a penalty. 2 Conservation
NetDMR was submitted without exemption codes, which seams to be the issue. Re-valitaded the quarterly samples and resubmitted.
