RESOLVED

  1. The Supervisor of the Town is hereby authorized and directed to execute a Conservation Easement and Public Access Easement with Winnakee providing for the Town of Red Hook as Grantee, regarding Parcels A and B described above, and such other documents necessary in connection with such agreement. Such agreement shall be substantially the form on file with the Clerk, with such insubstantial changes as may be approved by the Supervisor.
  2. The Supervisor of the Town is hereby authorized and directed to execute a Conservation Easement and Public Access Easement with Winnakee providing for the Town of Red Hook as Grantee, regarding Parcels C and D described above, and such other documents necessary in connection with such agreement. Such agreement shall be substantially the form on file with the Clerk, with such insubstantial changes as may be approved by the Supervisor.
  3. The officers of the Town are duly authorized and directed to consummate the funding of the purchase of real property interests with respect to the Parcels through the application of funds for such purpose from the CPF, with an aggregate estimated total Town cost of not to exceed $272,799; and to take all action necessary in connection therewith, with such funding to be completed within six months of the date hereof unless an extension is approved in the discretion of the Town Board.

  • WHEREAS, an application and certain supplemental information has been submitted by the Winnakee Land Trust, Inc. ("Winnakee") for property comprising approximately 336+/- total acres, consisting of: an approximately 0.58 acre parcel of property, Tax Map No. 6173-16-946326 ("Parcel A"); an approximately 89.00 acre parcel of property, Tax Map No. 6273-00-019222 ("Parcel B"); an approximately 246.63 acre parcel of property, Tax Map No. 6173-00-847544 ("Parcel C"); and an approximately 0.17 acre parcel of property, Tax Map No. 6173-16-980322 ("Parcel D"); located at Aspinwall Road, Route 9G, Kelly Road, and Whalesback Road, Town of Red Hook, County of Dutchess (collectively, the "Parcels" with respect to which Winnakee has entered into contracts of purchase)
  • WHEREAS, a public hearing was duly held by the Town Board on the 13th day of August, 2019 at 7:45 p.m. (Prevailing Time) at the Town Hall in the Town of Red Hook, and discussion on the matter having been had and all persons desiring to be heard having been heard, including those in favor of and those in opposition regarding the acquisition of interests or rights in real property to preserve open space with respect to the Parcels and to provide certain access rights to the Parcels
  • WHEREAS, pursuant to Chapter 57 of the Town Code, the Town Board has established a Community Preservation Fund ("CPF"), has adopted a Community Preservation Project Plan, as last amended April 24, 2019 (the "CPF Plan"), and has issued a request for applications under the CPF Plan; and the Community Preservation Fund Advisory Board ("CPF Board") has reviewed the proposals received at a meeting on July 24, 2019 based on the priority rankings set forth in the CPF Plan, and has recommended that the Town Board allocate moneys from the CPF for the Parcels
  • WHEREAS, the proposed acquisition cost for the conservation easement and public access easement with respect to the Parcels is supported by an appraisal by Al DeKrey of McGrath & Company, Inc. dated as of June 6, 2019 and June 7, 2019 respectively, updated as of September 30, 2019
  • WHEREAS, the Town Board has determined that such action is an unlisted action pursuant to the State Environmental Quality Review Act and, based on the review of an Environmental Assessment Form and all other information available to the Board, that the proposed action will not have a significant effect on the environment
  • WHEREAS, with respect to the Parcels, the Town's proposed project partner, Winnakee Land Trust, Inc., has obtained a commitment from the New York State Department of Environmental Conservation for funding of 80% of the acquisition cost of the Parcels by Winnakee in fee. It is proposed that the Town acquire the conservation easement and public access easement over Parcels A and B and over Parcels C and D. The total project cost to be borne by the Town is estimated not to exceed $96,013 as to Parcels A and B, and $176,786 as to Parcels C and D, and such cost is proposed to be financed from the CPF Program and is not in excess of the appraised value of such interests
  • WHEREAS, it is proposed that the Town shall hold a perpetual conservation easement and public access easement over the Parcels, and proposed forms of easement agreements have been submitted to the Town Board of the Town of Red Hook and are on file with the Town Clerk
  • WHEREAS, the Town Board has given due consideration to the recommendation of the CPF Board, and has further reviewed the application documents and appraisals and has determined that the purchase of such real property interests in Parcels A and B and in Parcels C and D are each high priority projects on the basis of the importance of the resources to be preserved, the anticipated availability of funding by others, and the availability of funding under the Town's CPF
  • WHEREAS, the purchase of real property interests in the Parcels as proposed is in the best interests of the Town and is the best alternative for the protection of community character of all the reasonable alternatives available to the Town
  • WHEREAS, the Town's purchase will be subject to Winnakee's acquisition of the fee interest in the respective parcels
