RESOLVED
- The Supervisor, or in his absence or unavailability the Deputy Supervisor, is authorized to accept and execute the foregoing ROW agreements for the Project in substantially the form on file with the Clerk, with such insubstantial changes as may be approved by the officer executing the same
- The officers, employees and agents of the Town are hereby authorized and directed for and in the name and on behalf of the Town to do all acts and things as may be necessary or, in the opinion of the officer, employee or agent acting, desirable and proper to effect the purposes of the foregoing resolution
- The officers of the Town are authorized to do all things necessary or convenient to carry out the foregoing agreements

- WHEREAS, by resolution dated January 14, 2025, the Town Board authorized a project for the Red Hook Saw Kill Road Bridge Replacement, Town of Red Hook, Dutchess County, BPIN 2262850, P.I.N. 8762.65 (the "Project"), eligible for funding under Title 23 U.S. Code, as amended, with the costs of such program to be borne at the ratio of 95% Federal funds and 5% non-federal funds
- WHEREAS, Hudson Valley Engineering Associates, PC d/b/a HVEA Engineers (the "Engineer") entered into an agreement with the Town dated as of January 25, 2023, as amended, for preliminary and detailed design and right-of-way services necessary for the Project
- WHEREAS, the Engineer has prepared plans for the Project including required acquisition of temporary and permanent right of way areas for portions of the following parcels adjacent to the existing bridge area: Tax Map 6173-16-764449, Tax Map 6173-00-847533, and Tax Map 6173-16-762415, as described in the maps on file with the Town Clerk, the Engineer and/or its consultants have prepared proposed forms of ROW agreements for conveyance of such rights of way to the Town, and the proposed cost of acquisition of the right of way interests in each case does not exceed the appraised value thereof
- WHEREAS, the Town Board has determined under the State Environmental Quality Review Act that the Project will not have a significant effect on the environment
