RESOLVED
- Acceptance of a surety bond in the form and amount approved by the Planning Board as aforesaid and for the purpose referred to herein is authorized upon completion of the following conditions: (a) Delivery to the Town Clerk of the original executed surety bond in form and substance satisfactory to the Attorney for the Town in the amount of $15,000 for completion of the improvements, as reviewed and recommended by the Town Engineer, in full force and effect, conditioned on completion of the improvements in accordance with the subdivision plan, all required plans, conditions and specifications, which bond shall be for an initial period of not less than one year renewable in one year increments, or delivery of a bank check payable to the Town of Red Hook to be held in an escrow account for such purpose; and (b) Receipt by the Town of payment for any and all outstanding consultant invoices included estimated costs, bringing the escrow account for development review costs fully up to date
- The Supervisor, Town Clerk, Town Engineer, and Attorney for the Town may take all steps reasonable and necessary in consultation with the Attorney for the Town to implement the intent of this resolution

- WHEREAS, by Resolution dated October 18th, 2021, the Red Hook Planning Board granted final approval to the Sycamore Acres Subdivision shown on Filed Map 12152A ("Filed Map")
- WHEREAS, a Declaration of Easement & Driveway Maintenance Agreement ("Maintenance Agreement") dated January 14th, 2022 executed by Trilby Sieverding was recorded February 8th, 2022 in the office of the Dutchess County Clerk as Document No. 02 2022 545 with respect to the common driveway depicted on the Filed Map accessing Yantz Road
- WHEREAS, the Town Engineer has provided its letter dated November 9, 2022, stating that the improvements required to be completed prior to the issuance of a certificate of occupancy for Sycamore Estates have been completed except for the specified improvements described therein, and the Town Engineer has agreed with an estimate in the total amount of $15,000 for the cost of the remaining improvements
- WHEREAS, pursuant to Section 143-120 of the Town Code, no certificate of occupancy shall be issued until all improvements shown on the approved site plan are installed and an as-built drawing submitted to the Zoning Enforcement Officer or a sufficient performance guaranty has been posted for improvements not yet completed
- WHEREAS, such completion performance guaranty shall be posted in accordance with the procedures specified within § 277 of the Town Law relating to subdivisions
- WHEREAS, the Town of Red Hook Planning Board by resolution dated December 5, 2022 has authorized acceptance of a surety bond in the amount of $15,000 securing the completion of the improvements, subject to approval of the form of guaranty by the Town Board
