RESOLVED

  1. the Town Board hereby determines that the action as proposed will not result in any significant adverse environmental impacts and that a Draft Environmental Impact Statement will not be prepared. The Town Board adopts the findings and conclusions relating to probable environmental effects contained with the attached EAF and Negative Declaration concluding that the subdivision and conveyance of property with respect to the parcels described above will not have an adverse impact on the environment
  2. the Supervisor is authorized to execute the EAF and file the Negative Declaration in accordance with the applicable provisions of law
  3. the Town Board authorizes and directs the Town Clerk to distribute a copy of this resolution and notice of determination of non-significance to all involved and interested agencies, the Town Supervisor, and any person that has requested a copy, to file notice of the same in the Environmental Notice Bulletin, and to make all other filings required by law

  • WHEREAS, the Town Board of the Town of Red Hook acquired certain parcels of land and interests in land on the Cookingham Farm west of Albany Post Road (US Route 9), including 68 Willow Brook Lane, 7617 N. Broadway, 69 Linden Avenue, and 7621 N. Broadway, using funds from the Red Hook Community Preservation Fund and Red Hook Open Space Incentive Zoning Program for the purpose of preserving important farmlands and other public purposes
  • WHEREAS, the Town has placed a conservation easement on approximately 72.206 acres of the lands acquired and seeks to subdivide and convey a portion of the lands, including the lands subject to the conservation easement, in the approximate configuration described in a map prepared by Mark Graminski dated September 1, 2023 and entitled "Subdivision of Lands of Town of Red Hook"
  • WHEREAS, on August 23, 2023, after review of a Part 1 EAF for the proposed acquisition, the Town Board classified the proposed action as a Type I action under SEQRA and declared its intent to serve as lead agency in a coordinated review, to which no other agency objected
  • WHEREAS, the Town Board has reviewed a Full Environmental Assessment Form (EAF) for the proposed action, as supplemented by the proposed subdivision map and information obtained through its own knowledge, its consultants and other agencies
  • WHEREAS, the Town Board has considered the criteria contained in 6 NYCRR Sec. 617.7 and thoroughly analyzed all identified relevant areas of environmental concern, and has reviewed a draft Negative Declaration setting forth reasons supporting a determination that the proposed action will not have a significant adverse impact on the environment
