RESOLVED

  1. Acceptance of the Easement is hereby authorized, subject to the delivery of a form of permanent easement and conveyance documents in substantially in the form on file with the Clerk and approved by the Attorney for the Town and the Town Engineer
  2. The Supervisor is authorized and directed to execute the Easement and the Supervisor and the officers, employees and agents of the Town may take all steps reasonable and necessary, in consultation with the Attorney for the Town, to implement the intent of this Resolution

  • WHEREAS, Rhinebeck Bank is the owner of a certain parcel of real property located at 7346 South Broadway, Red Hook, NY 12571 adjacent to the Town Hall property
  • WHEREAS, the Town is desirous of installing additional electric vehicle charging stations to be located at the Town's Property, which requires the installation of an underground electrical line along the property boundary shared by the Grantor's Property and the Town's Property
  • WHEREAS, Grantor has offered to grant to the Town a permanent and perpetual non-exclusive easement measuring 10 feet in width, running easterly approximately 253 feet starting at South Broadway (a/k/a Route 9) and continuing along the property boundary line shared by the Grantor's Property and the Town's Property, for the purpose of installing and maintaining the underground electrical line (the "Easement")
  • WHEREAS, the acceptance of the Easement is in the best interest of the Town, subject to the conditions set forth therein
