RESOLUTION AUTHORIZING THE IMPLEMENTATION AND FUNDING IN THE FIRST INSTANCE OF 100% OF THE FEDERAL-AID AND STATE MARCHISELLI PROGRAM-AID ELIGIBLE COSTS, OF A TRANSPORTATION FEDERAL-AID PROJECT FOR SAW KILL ROAD BRIDGE SUPPLEMENTAL FUNDING, AND APPROPRIATING FUNDS THEREFOR

RESOLVED

1. The Town Board does hereby approve the Project.
2. The Town Board of the Town of Red Hook does hereby authorize the Town of Red Hook to pay in the first instance 100% of the federal and non-federal share of the cost of right-of-way acquisition work for the Project or portions thereof, with the understanding that qualified costs may be eligible for federal-aid, state-aid, or reimbursement from Bridge NY funds.
3. The sum of $33,787 is hereby appropriated from Unappropriated Reserve B Fund and made available to cover the cost of participation in the above phase of the Project, together with the initial amount of $250,000 for a total of $283,787 for preliminary engineering and design, right of way incidentals, and right of way acquisition.
4. In the event the Project costs not covered by federal-aid, state-aid, or NY Bridge funding exceed the amount appropriated above, the Town of Red Hook Board shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Town Supervisor thereof.
5. Town of Red Hook hereby agrees that construction of the Project shall begin no later than twenty-four (24) months after award and the construction phase of the Project shall be completed within thirty (30) months.
6. The Supervisor of the Town of Red Hook is hereby authorized to execute all necessary agreements, certifications or reimbursement requests for Federal Aid and/or applicable Marchiselli Aid on behalf of the Town of Red Hook with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of Project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefor that are not so eligible.
7. In addition to the Town Supervisor, the Deputy Supervisor is also hereby authorized to execute any necessary agreements or certifications on behalf of the Town of Red Hook, with NYSDOT in connection with the advancement or approval of the Project identified in the State/Local Agreement.
8. In addition to the Town Supervisor and the Deputy Supervisor, the Town Bookkeeper is also hereby authorized to execute any necessary certifications on behalf of the Town of Red Hook, in connection with the advancement or approval of the Project.
9. A certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project.
10. This Resolution shall take effect immediately.
