RESOLVED

  1. The Town Clerk is hereby authorized and directed to file a certified copy of this resolution, in duplicate, in the office of the State Department of Audit and Control, at Albany, New York, together with an application in duplicate, for permission to so establish the District in the manner and form prescribed by Section 209-h of the Town Law of New York, within ten (10) days after adoption hereof
  2. On the basis of the information on file with the Town, the Town Board hereby finds, determines and declares that the application attached hereto and incorporated herein by reference (the "Application") was prepared at the direction of the Town Board; that the Board believes the contents of the Application to be accurate; that the Board has determined that the establishment of the District and the improvements to be made therein are in the public interest and will not constitute an undue burden on the property which will bear the cost thereof; and that all real property to be assessed for the cost of the proposed improvements will be benefited by the proposed improvements and no benefited property has been excluded
  3. The Town Supervisor, or in his absence or unavailability the Deputy Supervisor, is hereby authorized and directed to execute and verify said application on behalf of the Town
  4. Pursuant to Section 209-h of the Town Law, the District Resolution is subject to a permissive referendum; in the event that as of July 11, 2024, no petition has been filed in the manner required by Section 209-h and Article 7 of the Town Law requesting a referendum with respect to the Resolution, the Resolution shall be effective as of July 11, 2024, and the Town Clerk shall thereupon file in the Office of the State Comptroller her affidavit as to such petition
  5. This resolution shall take effect immediately

  • WHEREAS, the Town Board of the Town of Red Hook (herein called "Town Board" and "Town", respectively), in the County of Dutchess, New York, by resolution adopted June 11, 2024 (the "District Resolution") after a public hearing duly called and held, has authorized the establishment of Town of Red Hook Sewer District #1 (the "District") in the Town, pursuant to Section 209-h of the Town Law, and the improvement of facilities therein
  • WHEREAS, in accordance with Section 209-h of the Town Law, the District Resolution is subject to permissive referendum and the approval of the State Comptroller is required
