RESOLVED

  1. Execution and delivery of the decommissioning agreement is hereby authorized substantially in the form on file with the Clerk and as approved by the Town Engineer, subject to compliance with the conditions thereof and of the site plan and special permit approved by the Planning Board.
  2. The Supervisor is authorized and directed to execute the decommissioning agreement and the officers, employees and agents of the Town may take all steps reasonable and necessary, in consultation with the Attorney for the Town, to implement the intent of this Resolution.

  • WHEREAS, a proposed form of decommissioning agreement providing for a decommissioning plan pursuant to Section 143-37(3) (j) of the Town Code with respect to the Project is on file with the Town Clerk
  • WHEREAS, the execution of the decommissioning agreement is in the best interest of the Town, subject to the conditions set forth therein
