RESOLVED

  1. Based on the correspondence from DCWWA and the authorization to Operate from DCDBH for the completed sewer and water improvements for Section 7 of the Project, the required bond amount for Section 7 may be reduced to $39,428.80 and converted to a maintenance bond.
  2. The Project remains subject to all other applicable requirements of Resolution #39 of 2022 as to Section 7.
  3. The Supervisor and Town Engineer may take all steps reasonable and necessary in consultation with the Attorney for the Town to implement the intent of this resolution.

  • WHEREAS, as a condition of Resolution #39 of 2022 adopted June 22, 2022, the developer of the Tradition at Red Hook, a 102 lot subdivision project to be developed in sections (formerly known as Hoffman TND project) (the "Project") delivered to the Town Clerk a counterpart of a dual oblige bond in the amount of $197,144.00 for Section 7 water and sewer improvements, of which $6,888.00 is for water and $190.256.00 is for sewer, pursuant to a Memorandum of Understanding ("MOU") with DCWWA (collectively the "DCWWA Performance Bonds")
  • WHEREAS, by letter dated June 28, 2023, the DCWWA has determined that the Project has met all conditions of the MOU for the sewer and water systems serving any properties in Section 7 subject to provision of a maintenance bond in the amount of 20% of the construction cost
  • WHEREAS, by letter dated June 28, 2023, the Dutchess County Department of Behavioral Health ("DCDBH") has notified the Town Board that the sewer and water improvements contemplated under Section 7 of the Project have been satisfactorily completed and that an Authorization to Operate has been authorized.
