RESOLVED

  1. Based on the correspondence from DCWWA and the report of the Town Engineer of the completed sewer and water improvements for Sections 4 and 5 of the Project, the required bond amount for Sections 4 and 5 may be reduced to $90,175.20.
  2. The Project remains subject to all other applicable requirements of Resolution #46 of 2021 as to Sections 4 and 5.
  3. The Supervisor and Town Engineer may take all steps reasonable and necessary in consultation with the Attorney for the Town to implement the intent of this resolution.

  • WHEREAS, as a condition of Resolution #46 of 2021 adopted August 10, 2021, the developer of the Tradition at Red Hook, a 102 lot subdivision project to be developed in sections (formerly known as Hoffman TND project) (the "Project") delivered to the Town Clerk a counterpart of a dual oblige bond in the amount of $450,876.00 for Sections 4 and 5 water and sewer improvements, of which $141,684.00 is for water and $309,192.00 is for sewer, pursuant to a Memorandum of Understanding ("MOU") with DCWWA (collectively the "DCWWA Performance Bonds")
  • WHEREAS, by letter dated August 1, 2022, the DCWWA has determined that the Project has met all conditions of the MOU for the sewer and water systems serving any properties in Sections 4 and 5, subject to provision of a maintenance bond in the amount of 20% of the construction cost
  • WHEREAS, by letter dated August 3, 2022, the Town Engineer has notified the Town Board that the sewer and water improvements contemplated under Sections 4 and 5 of the Project have been satisfactorily completed, and that it is recommended that the bond amounts required for Sections 4 and 5 be reduced accordingly
