RESOLVED

  1. The sale of Parcel 4 to RUPCO, Inc. at a price of $400,000.00 is approved for the purpose of development of a mix of affordable rental housing units and single family dwelling units where at least 75% of such units are affordable to persons and families at or below 100% of area median income, and which development may include adaptive use of the existing barn for commercial use.
  2. The Supervisor or, in his absence, the Deputy Supervisor, is hereby authorized and directed to execute a purchase contract consistent with this resolution, and to execute and deliver the deed and other documents referred to therein in accordance with the terms thereof.
  3. The officers, employees and agents of the Town are hereby authorized and directed for and in the name and on behalf of the Town to do all acts and things as may be necessary or, in the opinion of the officer, employee or agent acting, desirable and proper to effect the purposes of the foregoing resolution.
  4. Within ten days after the adoption of this resolution, the Town Clerk is hereby authorized and directed to cause to be published at least once in the Poughkeepsie Journal, a newspaper having a general circulation in the Town and hereby designated as the official newspaper of the Town, and to be posted on the sign board of the Town maintained pursuant to the Town Law a notice which shall set forth the date of adoption of this resolution and contain an abstract thereof, concisely stating its purpose and effect and specifying that this resolution was adopted subject to permissive referendum.
  5. This resolution shall take effect thirty days after adoption, unless there shall be filed with the Town Clerk a petition signed and acknowledged by the electors of the Town qualified to vote upon a proposition to raise and expend money, in number equal to at least five percentum of the total vote cast for governor in the Town at the last general election held for the election of State offices, protesting against this resolution and requesting that the matter be submitted to the qualified electors of the Town at a referendum in the manner provided by Article Seven of the Town Law.

  • WHEREAS, the Town of Red Hook's Open Space Plan and Centers and Greenspaces Zoning encouraged the use of incentive zoning to channel growth to desirable locations, such as existing residential areas or commercial centers, in order to protect farmland
  • WHEREAS, Dutchess County's 2023 Housing Needs assessment identified the need for new affordable units to be developed in areas throughout the County, indicating that 'Sites that may be most suitable include ones with access to household services, alternative forms of transportation, and other necessary infrastructure (especially water and sewer), as would sites that reflect Dutchess County's "Centers and Greenspaces" approach to smart growth'
  • WHEREAS, the Town adopted Local Law 2 of 2023 authorizing incentive zoning fund benefits to be used for the permanent protection of open space and for low and moderate income housing projects in the Town including the Villages
  • WHEREAS, pursuant to a resolution approved February 22, 2023, the Town Board acquired the approximately 112.94+/- acre Cookingham Farm (East) located east of Rt. 9 as a single assemblage in order to preserve a critical mass of significant farmland, including acquisition of an interest or right in real property to preserve open space with respect to the Property from the Incentive Zoning Fund for purposes permitted by Section 143-49.2(E)(1)(c) of the Zoning Code; and identified and conveyed a 94 acre portion for agricultural and open space purposes, and reserved an approximately 12 acre portion of the assemblage known as Tax ID 134801-6272-07-581864-0000, Parcel 4 shown on FM 12979 ('Parcel 4'), for reconveyance for low- and moderate-income housing projects in the Town including the Villages
  • WHEREAS, RUPCO, Inc. is a not for profit corporation organized under the laws of the State of New York for charitable purpose including meeting the housing needs of persons and families of low or moderate income, with experience in the provision of affordable rental housing and single family homes
  • WHEREAS, the Town Board determined that such action is a Type I action and, based on the review of a supplemental Environmental Assessment Form and all other information available to the Board, that the proposed action will not have a significant effect on the environment
  • WHEREAS, further development of Parcel 4 by the purchaser will be subject to review and approval of a subdivision and site plan to be developed at a later date in conjunction with applications for financing from available local, state and federal sources
