RESOLVED

  1. The Town Board of the Town of Red Hook shall hold a public hearing on May 29, 2024, at 7:50 p.m. at the Town Hall, 7340 South Broadway, Red Hook, New York, to hear all interested parties on said Sewer Project.
  2. The Town Clerk is hereby authorized and directed to publish notice of said public hearing in the Poughkeepsie Journal, the official newspaper of said Town, on or before May 19, 2024, which is not less than ten (10) calendar days prior to the date of said public hearing.

  • WHEREAS, the Town of Red Hook is proposing to create a municipal sewer district pursuant to Article 12-A of NYS Town Law (the "Sewer District") to serve the TND district corridor as set forth in a Map, Plan and Report on file with the Town Clerk
  • WHEREAS, the proposed Sewer District is proposed to discharge to the Village of Red Hook sewer plant pursuant to a proposed intermunicipal agreement (the "IMA")
  • WHEREAS, on May 8, 2024, the Town Board reviewed a Full Environmental Assessment Form ("EAF") for the proposed actions described therein (the "Proposed Action")
  • WHEREAS, on May 8, 2024, the Town Board classified the Proposed Action as an unlisted action under SEQRA and declared its intent to serve as lead agency in a coordinated review of the Proposed Action
  • WHEREAS, as part of its consideration of the proposed project, the Town Board will determine whether and to what extent the Town of Red Hook zoning laws apply to the proposed project; and as part of such review the Town Board will consider the following nine factors set forth in Matter of County of Monroe v. City of Rochester: the nature and scope of the instrumentality seeking immunity; the encroaching government's legislative grant of authority; the kind of function or land use involved; the effect local land use regulation would have on the enterprise concerned; alternative locations for the facility in less restrictive zoning areas; the impact upon legitimate local interests; alternative methods of providing the proposed improvement; the extent of the public interest to be served by the improvements; and intergovernmental participation in the project development process and an opportunity to be heard
