RESOLVED
- The Town Board of the Town of Red Hook shall hold a public hearing on August 11, 2026, at 7:35 p.m. at the Town Hall, 7340 South Broadway, Red Hook, New York, to hear all interested parties on said proposed disposition of the Water District Parcels.
- The Town Board of the Town of Red Hook shall hold a concurrent public hearing at such date, time and place to hear all interested parties on the proposed acquisition of the Water District Parcels using CPF moneys pursuant to the Community Preservation Fund Program.
- The proposed use of CPF Fund moneys for the acquisition of the Water District Parcels shall be referred to the CPF Advisory Committee duly appointed by the Board (the "Committee") for review of such proposed acquisition and rating according to the Program criteria established by the Board, taking into account the importance of the resource and the anticipated availability of funding by others and the availability of funding under the Town's Community Preservation Fund Program.
- The Town Clerk is hereby authorized and directed to publish notice of said public hearing not earlier than July 22, 2026, and not later than August 1, 2026, which is not less than 10 days nor more than 20 days prior to the date of said public hearing.

- WHEREAS, the Town of Red Hook, on behalf of the Town of Red Hook Water District #1 (the "Water District"), owns parcels located in Red Hook, New York, 12571, identified in the form of notice attached hereto and incorporated herein by reference, collectively totaling approximately 8.55 acres (the "Water District Parcels")
- WHEREAS, the Water District Parcels are vacant parcels, formerly the site of water source wells, which the Water Board has determined are unneeded for purposes of the Water District
- WHEREAS, pursuant to Town Law § 198(12), real or personal property owned by, but not required for the purposes of, any improvement district may be sold or leased by the Town Board on behalf of the Water District, provided that when the value of the said property is in excess of One Thousand Dollars a public hearing shall be held with notice of such hearing to be published in the official newspaper of the Town on not less than ten nor more than twenty days prior to the date of said public hearing
- WHEREAS, pursuant to the Town's Community Preservation Fund Program, an application has been submitted by the Town as described on the attached form of notice ("Notice") proposing the purchase of the Water District Parcels for the purpose of preservation of open space including wetland areas
- WHEREAS, the proposed terms of sale are to be based on the estimated fair value of the Water District Parcels as determined by the Town Board on the basis of an appraisal, and receipts from the conveyance are to be credited to the Water District to be expended for any purpose which would be properly charged against the entire district
