RESOLVED
- A public hearing will be held at 6:30 p.m. on May 16, 2025 at the Red Hook High School Performing Arts Center, located at 103 West Market St., Red Hook, NY 12571: (a) to inform the public of the Town Board's proposal to take, by eminent domain, all the real property located at 256 Dock Road, 6072-02-897911-0000 and Dock Road, SBL No. 6072-02-897893-0000; and (b) to review both the public use to be served by the proposed acquisition, as well as the impact on the environment and residents of the locality where those actions will occur.
- The Town Clerk is directed to publish the attached Public Notice in the Town's Official Newspaper, the Poughkeepsie Journal, which is a daily paper, in five successive daily issues, with the first publication no less than ten nor more than 30 days before the hearing, and to post the Public Hearing Notice at Town Hall.
- The Town's special counsel is to mail notice of the hearing, certified mail, return receipt requested, to the record owners of the subject property, no less than ten nor more than 30 days before the hearing, and upon their counsel of record. The Town's special counsel is also directed to complete personal service upon the property owner.
- Town staff and special counsel are authorized to take such steps as are necessary to effectuate the purposes of this Resolution.

Show preamble — 4 WHEREAS clauses
- WHEREAS, the Town Board of the Town of Red Hook (the "Town Board") is considering the acquisition by eminent domain of the following property located in the Town of Red Hook, which is currently the Red Hook Boat Club: 256 Dock Road, 6072-02-897911-0000 and Dock Road, SBL No. 6072-02-897893-0000 (collectively the "Property")
- WHEREAS, the Town Board is considering said acquisition for the following public purpose(s) to provide for public waterfront recreational facilities including boat launch, boat slips, clubhouse, picnic area and related facilities, which furthers the goal of the 1993 Town Comprehensive Plan that called for consideration of the development of Hudson Riverfront parks in Barrytown to provide the Town's people "windows on the Hudson" as well as preserving waterfront open space
- WHEREAS, the Town Board hereby determines that there are no viable alternate locations for the proposed public project because 1) as noted in the Local Waterfront Revitalization Plan ("LWRP") there is limited physical access to the waterfront within the Town because of the train tracks with the Barrytown area being an exception due to a bridge over the tracks; 2) in terms of public access to waterfront recreational facilities, there "are several water-related use sites that are privately held," (LWRP Section 2.8) but no similar publicly owned facilities exist in the Town, 3) as noted in the LWRP the primary publicly available locations for water-related uses are the state owned areas within the Tivoli Bays Wildlife Management Area and Research Reserve, which are passive recreation area owned by the Department of Environmental Conservation, which has constructed a small landing for the hand-launching of boats, used primarily for research, education and non-consumptive nature recreation, but also for fishing and duck hunting, which site has a small adjacent parking area accessible from Kidd Lane, but does not provide the type of facilities or opportunities as the Property, and the second DEC site that provides public access to Tivoli South Bay is at the end of Cruger Island Road; however, this site is a poor boat launching location as there is a lack of water near shore at low tide, and DEC efforts are aimed making the site to a more suitable "Marsh Viewing Site," not a public waterfront park; 5) other access is limited to low tide when boaters can go under railroad bridges to get to the river while most of these smaller, hand-launched boats are not suitable for extended river stays, and therefore the acquisition of the Red Hook Boat Club Property provides the best and most efficient opportunity to further the purposes of the LWRP, Comprehensive Plan, and provide waterfront recreational facilities for the Town residents while preserving Riverfront open space
- WHEREAS, the Town Board wishes to hold a public hearing under Article 2 of the Eminent Domain Procedure Law with respect to the Property to allow the owner and the public to provide information at the hearing to be considered by the Town Board.
