RESOLVED
- The Town Board hereby authorizes the Supervisor to give notice of termination of the IMA in accordance with the IMA
- The officers of the Town are hereby authorized and directed to take all other actions as may be required by law
Show preamble — 5 WHEREAS clauses
- WHEREAS, the Town of Red Hook entered into an Intermunicipal Agreement for Equipment Sharing (Mini-Excavator) dated as of March 3, 2016 with the Town of Milan, the Town of Clinton, and the Town of Rhinebeck (the "IMA") whereby the towns jointly purchased a mini-excavator (the "Equipment") funded by a Municipal Consolidation and Shared Services Grant in the amount of $70,000 from Dutchess County provided pursuant to an Agreement dated as of April 19, 2016 between Dutchess County and the Town of Clinton (the "County Agreement")
- WHEREAS, Highway Superintendent Theresa Burke has recommended that the Town terminate the IMA because it has purchased a Town compact excavator and has no further use for the Equipment
- WHEREAS, Dutchess County has confirmed to the Highway Superintendent that the County Agreement has expired and that the terms of the IMA would govern withdrawal
- WHEREAS, pursuant to the IMA, a Town may give written notice of termination to the other towns at least 90 days prior to termination, and in the event of termination by a town the remaining towns assume responsibility for the service and maintenance of the Equipment
- WHEREAS, it is in the best interests of the Town to terminate the IMA as recommended by the Highway Superintendent
