RESOLVED

  1. The Town Board hereby adopts said LOCAL LAW NO. E-1 (PROPOSED) OF 2024; A local law amending the Town Code Chapter 53 entitled "Cannabis" adding a new Article II entitled "Regulation of Retail Dispensaries and adding a new Article III entitled "Regulation of Smoking and Vaping" as Local Law No. 4 of 2024 in the form on file with the Town Clerk
  2. The Town Clerk hereby is directed to enter said Local Law in the minutes of this meeting and in the Town Code of the Town of Red Hook, to give due notice of the adoption of said Local Law to the Secretary of State of New York, and to take all other actions as may be required by law

E (PROPOSED) OF 2024; A local law amending the Town Code Chapter 53 entitled "Cannabis" adding a new Article II entitled "Regulation of Retail Dispensaries and adding a new Article III entitled "Regulation of Smoking and Vaping" (the "Proposed Local Law") was presented to the Town Board at a regular meeting held on November 20, 2024
  • WHEREAS, a resolution was duly adopted by the Town Board of the Town of Red Hook on November 20, 2024, setting a public hearing to be held by said Town Board on December 10, 2024 at 8:20 p.m. at the Town Hall, 7340 South Broadway, Red Hook, New York, to hear all interested parties on said Proposed Local Law, and notice of said public hearing was duly advertised and posted
  • WHEREAS, said public hearing was duly held on December 10, 2024 at said time and place, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said Proposed Local Law, or any part thereof
  • WHEREAS, based on the information presented at such hearing and the Town's own study of the matter, an amended form of such local law, referred to as Local Law E-1 (Proposed) of 2024 entitled "Local Law No. E-1 (Proposed) of 2024; A local law amending the Town Code Chapter 53 entitled "Cannabis" adding a new Article II entitled "Regulation of Retail Dispensaries and adding a new Article III entitled "Regulation of Smoking and Vaping" ("Revised Proposed Local Law") was presented to the Town Board and placed on file with the Town Clerk, and the Town Board set a date for a further public hearing on said Local Law B-1 for December 30, 2024 at 7:45 p.m.
  • WHEREAS, said public hearing was duly held on December 30, 2024, at said time and place, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said Revised Proposed Local Law, or any part thereof
  • WHEREAS, notice of said continued public hearing was duly advertised in the Poughkeepsie Journal, the official newspaper of said Town, on December 17, 2024 which is not less than five days prior to the date of said public hearing
  • WHEREAS, the amendments are designed to protect the health, safety, and welfare of Town residents from second-hand smoke and vapor in public spaces to help role model non-smoking behavior to children and youth; to provide children, youth and their families with a safe, smoke-free environment
  • WHEREAS, the proposed action is a SEQR Type II action as routine or continuing agency administration, and there are no other involved agencies
  • WHEREAS, the Town Board of the Town of Red Hook, after reviewing the comments received and after due deliberation, finds it in the best interests of the Town to adopt said Revised Proposed Local Law, in the form on file with the Town Clerk
