RESOLVED
- The Town Board hereby adopts said Local Law D-3 (Proposed) of 2024 with the clarification proposed January 29, 2025, on file with the Town Clerk, now to be referred to as Local Law No. 1 of 2025, entitled Local Law No. 1 of 2025; A local law updating and amending the Town Zoning Law in the form attached hereto and made a part of this resolution
- The Town Clerk hereby is directed to enter said local law in the minutes of this meeting and in the Town Code of the Town of Red Hook, to give due notice of the adoption of said local law to the Secretary of State of New York, and to take all other actions as may be required by law.

- WHEREAS, pursuant to a resolution of the Town Board adopted November 20, 2024, a public hearing was duly held on December 10, 2024 at 8:20 p.m., and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof
- WHEREAS, based on the information presented at such hearing, and the Town's own study of the matter, there was proposed and presented to this Board an amended form of such local law, referred to as Local Law D-1 (Proposed) of 2024 entitled LOCAL LAW NO. D-1 (PROPOSED) of 2024; A LOCAL LAW UPDATING AND AMENDING THE TOWN ZONING LAW in the form on file with the Town Clerk
- WHEREAS, pursuant to a resolution of the Town Board adopted December 10, 2024, a public hearing regarding the revised proposed local law was duly held on December 30, 2024, at 7:35 p.m, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof
- WHEREAS, pursuant to Section 239-m of the General Municipal Law, the proposed amendments to the zoning law were referred to the Department of Planning and Development, which reported that it was a matter of local concern with comments dated December 26, 2024
- WHEREAS, based on the information presented at such continued hearing, including comments of the Planning Board, the Department of Planning and Development, and the Town's own study of the matter, there was proposed and presented to this Board an amended form of such local law, referred to as Local Law D-2 (Proposed) of 2024 entitled LOCAL LAW NO. D-2 (PROPOSED) of 2024; A LOCAL LAW UPDATING AND AMENDING THE TOWN ZONING LAW in the form on file with the Town Clerk

- WHEREAS, based on the information presented at such continued hearing, including comments of the Planning Board, the Department of Planning and Development, and the Town's own study of the matter, there was proposed and presented to this Board an amended form of such local law, referred to as Local Law D-3 (Proposed) of 2024 entitled LOCAL LAW NO. D-3 (PROPOSED) of 2024; A LOCAL LAW UPDATING AND AMENDING THE TOWN ZONING LAW in the form on file with the Town Clerk
- WHEREAS, at its meeting on January 14, 2025, the Town Board continued the public hearing regarding the revised proposed local law to January 29, 2025 at 7:35 p.m, and said continued public hearing was duly held on January 29, 2025 at 7:35 p.m., and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof
- WHEREAS, at its meeting on January 29, 2025, a proposed clarification was laid on the desks of the Town Board to replace or such larger setback as provided with or such larger adjacent land area as determined by NYS DEC pursuant to in the proposed local law
- WHEREAS, at its meeting on February 3, 2025, the Planning Board recommended a finding that the proposed action is consistent with the Town's Local Waterfront Revitalization Plan
- WHEREAS, based on the information presented to the Board, including comments of the public, comments of the Planning Board, the Department of Planning and Development, and the Town's own study of the matter, the Town Board has determined that the adoption of the proposed zoning amendments, as revised as of the date hereof and on file with the Town Clerk, are necessary to protect the health, safety, and welfare of Town residents and to bring the Town's Zoning Law into conformance with Greenway Connections: Greenway Compact Program and Guides for Dutchess County Communities pursuant to Chapter 17 of the Town Code and with applicable state and federal law, and are consistent with the Town Comprehensive Plan
- WHEREAS, the Town Board has determined that the proposed action is consistent with the Town's Local Waterfront Revitalization Program and has determined that the proposed action will not have a significant adverse impact on the environment
