RESOLVED
- The Town Board of the Town of Red Hook shall hold a public hearing on February 27, 2019 at 7:45 p.m. at the Town Hall, 7340 South Broadway, Red Hook, New York, to hear all interested parties on said proposed local law and at which time and place the Town Board may determine whether to adopt the proposed local law
- The Town Clerk is hereby authorized and directed to publish notice of said public hearing in the Poughkeepsie Journal, the official newspaper of said Town, on or before February 17, which is not less than ten calendar days prior to the date of said public hearing
- The Town Clerk is hereby authorized and directed to refer a copy of Local Law B (Proposed) of 2019, to the Planning Board, for a report and recommendation thereon pursuant to Section 143-141 of the Zoning Law
- The Town Clerk is hereby authorized and directed to refer a copy of Local Law B (Proposed) of 2019, to the Dutchess County Department of Planning and Development for a report and recommendation thereon pursuant to Section 239-m of the General Municipal Law
- The Town Clerk is hereby authorized and directed to send notice of said public hearing to the clerks of adjacent municipalities
Show preamble — 8 WHEREAS clauses
- WHEREAS, by Local Law 3 of 2017, the Town enacted a 12-month moratorium on extractive operations, extended by Local Law 4 of 2018, which is set to expire on or about March 4, 2019
- WHEREAS, the Town has authorized the Conservation Advisory Council (CAC) to recommend amendments to the Town's Zoning Law to implement the recommendations in the Town's Comprehensive Plan regarding resource protection, and specifically aquifer protection, water resources for public supply, erosion and sediment control, extractive operations including soil mining, timber harvesting, and to study the secondary impacts of water withdrawal and surface extraction, including the study and protection of aquifer, public water supplies, and agricultural resources of the Town
- WHEREAS, a working group of the CAC together with the Town Board liaison and planning consultant have met regularly to review study recommendations regarding this matter
- WHEREAS, following presentation of a preliminary report dated May 2018, the CAC working group met regularly with the Town's planning consultant to propose specific regulations and there has now been prepared and submitted to the Town board a draft form of local law with a report of the working group's recommendations dated January 18, 2019
- WHEREAS, the Town Board needs additional time to review the recommended local law and believes that it is necessary and in the best interests of the Town to consider a limited further extension of the moratorium for this purpose
- WHEREAS, a proposed form of Local Law No. B (Proposed) of 2019 entitled "A LOCAL LAW TO ENACT AN EXTENSION ENDING JUNE 4, 2019, OF A MORATORIUM ON LARGE SCALE COMMERCIAL EXTRACTIVE OPERATIONS IN THE TOWN OF RED HOOK" has been submitted to the Town Board of the Town of Red Hook
- WHEREAS, pursuant to Section 239-m of the General Municipal Law, proposed amendments to the zoning law must be referred to the Department of Planning and Development for its review and report thereon
- WHEREAS, the proposed Local Law constitutes a Type II action for purposes of the State Environmental Quality Review Act
