RESOLVED
- The Supervisor, or in his absence or unavailability the Deputy Supervisor, is hereby authorized and directed to execute the Amendment 1 to Intermunicipal Sewer Agreement in substantially the form on file with the Town Clerk, with such changes as shall be approved by the officer executing the same and which do not affect the substance thereof.
- The Supervisor, the Town Clerk, and the Town's other officers, employees and agents are hereby authorized and directed for, and in the name and on behalf of the Town, to do all acts and things required or provided by the provisions of the Intermunicipal Sewer Agreement.
- This resolution shall take effect immediately.

- WHEREAS, the Town of Red Hook is proposing to create a municipal sewer district pursuant to Article 12-A of NYS Town Law (the 'Project') to serve the Traditional Neighborhood Development District ('TND') corridor as set forth in a Map, Plan and Report dated May 2024 ('SD # 1 MPR') prepared by T&B Engineering and Landscape Architecture, P.C. on file with the Town Clerk
- WHEREAS, the sewer district is proposed to discharge to the existing Village of Red Hook ('Village') sewer plant pursuant to an Intermunicipal Sewer Agreement dated as of June 10, 2024 executed by the Village and Town (the 'IMA')
- WHEREAS, a proposed amendment to the IMA to provide for an initial project budget is on file with the Town Clerk, incorporating anticipated funding sources including NYS EFC subsidized borrowing and $554,205.23 in ARPA funds
- WHEREAS, on June 10, 2024, the Town Board adopted a Negative Declaration for the Project pursuant to the State Environmental Quality Review Act, determining that the Project does not have the potential to have significant adverse environmental impacts and that a Draft Environmental Impact Statement will not be prepared
