RESOLVED

  1. Water charges and penalties thereon shall be a lien upon the real property upon which the water is used and may be collected in accordance with § 11-1118 of the Village Law of the State of New York. This amendment shall take effect immediately upon filing in the office of the Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.

  • WHEREAS, the attached amendment to Chapter 195 Water Code was introduced by the Board of Trustees of the Village of Red Hook on February 6, 2012
  • WHEREAS, a public hearing was held on March 5, 2012, at 7:15 at the Village Hall, 7467 South Broadway, Red Hook, New York, notice of said hearing duly published and at which time all interested parties had an opportunity to be heard
  • WHEREAS, the Board of Trustees of the Village of Red Hook has determined this action to be an Unlisted action based on the criteria found in 6 NYCRR, § 617.4 and has determined that there are no adverse environmental impacts associated with the adoption of this Local Law, and the Village Board hereby issues a Negative Declaration in connection with the adoption of this Local Law

Resolved
  1. The Village of Red Hook is authorized to construct Phase I improvements to the Village water system, including the redevelopment of existing wells, the installation of monitoring and flow-control devices and a new generator; the construction of a new water storage tank; the installation of water meters and related software; and miscellaneous work and site restoration, with an estimated maximum cost of $1,300,000 and said amount is appropriated therefor, with financing to include the issuance of $1,300,000 serial bonds of the Village.
  2. Serial bonds of the Village in the principal amount of $1,300,000 are authorized to be issued pursuant to the Local Finance Law to finance said appropriation.
  3. The period of probable usefulness applicable to the object or purpose for which serial bonds are authorized is forty (40) years.
  4. Proceeds of the bonds and any bond anticipation notes may be applied to reimburse the Village for expenditures made after the effective date of this resolution for the purpose for which bonds are authorized.
  5. Pursuant to the State Environmental Quality Review Act (SEQRA), the Board of Trustees, acting as Lead Agency, has determined that the construction of the Project is a Type I Action, will not result in any significant adverse environmental impact, and a Negative Declaration and Notice of Determination of Non-Significance has been issued and filed.
  6. The proposed maturity of the bonds authorized will exceed five (5) years.
  7. Each bond authorized and any bond anticipation notes shall contain the recital of validity and shall be general obligations of the Village, payable as to both principal and interest by general tax upon all taxable real property within the Village, and the faith and credit of the Village are irrevocably pledged to punctual payment.
  8. Provision shall be made annually in the budget of the Village by appropriation for amortization and redemption of bonds and notes and payment of interest.
  9. Powers and duties of the Board of Trustees relative to authorizing bond anticipation notes and prescribing terms, form and contents and sale and issuance of bonds are delegated to the Village Treasurer.
  10. Validity of bonds and notes may be contested only under specified conditions and within twenty days after publication.
  11. This bond resolution is subject to a permissive referendum and the Village Clerk is authorized and directed to publish the resolution in full within ten (10) days in The Poughkeepsie Journal and post in at least six (6) public places and each polling place in the Village.
