The Board authorized the hiring of Z3 Consultants, Inc. (464 Freedom Plains Road, Poughkeepsie, NY 12603) to provide zoning enforcement, code enforcement, and building inspection services for the Village, including training of Village employees for administrative duties in the building/zoning office.[12][14]
CEO Violation Reversal — 26 Elizabeth Street Pre-Existing Non-Conforming Use
The Zoning Board of Appeals reversed the Code Enforcement Officer's violation dated February 1, 2023 regarding 26 Elizabeth Street, finding that the three-family residential use of the property predates the Village's adoption of zoning in September 1955 and constitutes a lawful pre-existing non-conforming use. The reversal does not exempt the property from compliance with all other applicable building, fire, and zoning code requirements.[13]
2021
Inter-Municipal Agreement — Shared Building Department Services
The Village has executed an Inter-Municipal Agreement with the Town of Red Hook for shared building department services, including fire inspections, at a service rate of $50 per hour. The agreement was first authorized in 2020 and subsequently re-authorized by Mayor Smythe in 2021.[8][10]
CEO/ZEO Enforcement Determination — 28 Prince Street Carport
The Zoning Board of Appeals upheld the Code Enforcement Officer's Notice of Violation dated December 11, 2020 regarding 28 Prince Street (tax no. 6272-10-337721), finding that the reconstructed carport with second-floor deck/porch violates the 1986 Variance and constitutes a violation of Village Zoning Law due to intensified use within the side yard setback and location closer to the property line than permitted. A Code Enforcement Officer's prior issuance of a building permit for the project was found to be ultra vires.[9]
2011
CEO/ZEO Proactive Violation Patrol Policy
The Code Enforcement Officer/Zoning Enforcement Officer is directed to be proactive and drive around the Village to identify code violations.[3]
Chapter 95 — Building and Fire Protection Code (Local Law 2-2011)
The Village adopted updated Chapter 95, incorporating the New York State Building Code and Fire Protection Code into the Village Code as Local Law 2-2011, keeping the Village in compliance with state law and authorizing administration of points of assembly.[4]
2008
Uniform Fire Prevention and Building Code — Local Law
The Village of Red Hook enacted Local Law Number 1-2006 to supplement and replace the prior law addressing issues contained in the Title 19 Uniform Fire Prevention and Building Code. A supplement to that code was subsequently enforced retroactively to Local Law 1-2006.[1][2]
