RESOLVED

  1. The Board hereby adopts the attached Notice of Negative Declaration, finding that the adoption of the Proposed Local Law will not result in any significant adverse environmental impacts and that a Draft Environmental Impact Statement will not be prepared.
  2. The Board hereby adopts the Proposed Local Law as Local Law No. ___ of 2018 ("The Local Law").
  3. That the Village Clerk be and she hereby is directed to enter said Local Law in the minutes of this meeting and in the Village Code of the Village of Red Hook, to give due notice of the adoption of said Local Law to the Secretary of State of New York, and take all other actions as may be required by law.
  4. The Village Clerk be and she hereby is directed to file notice of the Negative Declaration with the Environmental Notice Bulletin.

  • WHEREAS, a proposed form of a Local Law entitled "A Local Law Related to Motor Vehicle Service Stations" (the "Proposed Local Law") was presented to the Village Board of Trustees of the Village of Red Hook (the "Board") on September 20, 2018
  • WHEREAS, the Proposed Local Law would modify certain provisions of the Zoning Law regarding motor vehicle service stations and nonconforming uses and structures, and has been designed to protect the health, safety, and welfare of the community
  • WHEREAS, the Proposed Local Law is consistent with the Village's Comprehensive Plan
  • WHEREAS, a Full Environmental Assessment Form ("EAF") dated September 20, 2018 has been prepared on behalf of the Board
  • WHEREAS, on September 20, 2018, the Board classified the Proposed Local Law as a Type I action under the State Environmental Quality Review Act ("SEQRA") and determined that it was the only involved agency
  • WHEREAS, the Board has reviewed the EAF and information obtained through its own knowledge, the public hearing, its consultants and other agencies and has sufficient information on which to base a determination of significance
  • WHEREAS, the Board has considered the criteria contained in 6 NYCRR 617.7 and thoroughly analyzed all identified relevant areas of environmental concern
  • WHEREAS, pursuant to Section 239-m of the General Municipal Law, the proposed local law was referred to the Department of Planning and Development which responded on October 15, 2018, that it was a matter of local concern
  • WHEREAS, a duly noticed public hearing was held on October 15, 2018 during which all those who wished to speak were heard
