RESOLVED

  1. A letter of intent is issued for water supply to the TND Hoffman Residential Project
  2. This letter of intent does not waive any rights of the Village or any applicable regulation or law
  3. The letter is contingent on a formal district being created by the developer; capacity consideration and availability at the Village source/supply; supply pricing agreements to be determined later; and cost such as engineering and legal time be paid in escrow to the Village
  4. The Village recognizes options to enable viability of the project including district annexation, a town water district, a county zone of assessment operated by the Dutchess County Water and Wastewater Authority, or the establishment of another formal water district
