RESOLVED
- pursuant to Sections 201 and 202 of the Eminent Domain Procedures Law, the Board of Trustees of the Village of Red Hook determines the Board shall hold a public hearing on August 14, 2018, at 7 p.m. at the Village Hall, Red Hook, New York at which time the Board of Trustees will review the purpose and proposed location of the public project and other information including the economic, ecological and social effect upon the community and any other information including maps and descriptions of the property to be required
- the Village Clerk is hereby authorized and directed to publish notice of said public hearing in the official newspaper of said Village, in five successive issues, on or before 8-4, 2018 which is not more than thirty nor less than ten days prior to the date of said public hearing
- the Village Clerk is hereby authorized and directed to send notice to each assessment record billing owner notifying them of the public hearing by certified mail, return receipt requested, on or before 8-4, 2018 which is not more than thirty nor less than ten days prior to the date of said public hearing
- the Mayor is hereby authorized to obtain appraisals of each Temporary and Permanent Easement and to make a written offer for each Temporary and Permanent Easement for one hundred percent of the value so established

- WHEREAS, the Village of Red Hook has established a municipal sewer system to serve the Village pursuant to Article 14 of the NYS Village Law
- WHEREAS, the Village is seeking to construct the sewer system in phases with the first phase encompassing the general business district and contiguous areas (the "Sewer Project")
- WHEREAS, a map and plan of the permanent Sewer Project, with plans and specifications for sewage treatment, has been prepared by C.T. Male Associates, dated February 15, 2017, last revised May 8, 2017, entitled, "Map, Plan & Report, Village of Red Hook Sewer System" (the Map and Plan") and was filed in the Office of the Village Clerk on August 25, 2017
- WHEREAS, in order to construct the Sewer Project, the Village has attempted to acquire temporary and permanent easements for sewer system components over certain properties and negotiations with specified landowners for temporary and permanent easements have been unsuccessful
- WHEREAS, maps of the Permanent Easements and Temporary Easements are on file with the Village Clerk
- WHEREAS, the Permanent Easements proposed to be acquired consist generally of a rectangular piece of property for the installation of a holding tank and a ten foot right of way around all mains, lines and electrical conduits connecting the house and tank to the municipal sewer system
- WHEREAS, the Temporary Easements generally consist of the entire property to permit the installation of the sewer components
- WHEREAS, there are no alternate locations proposed for the installation of the sewer system components within the Sewer Project area
