VILLAGE OF RED HOOK BOARD OF TRUSTEES

RESOLUTION NO. ____-2026

A RESOLUTION ESTABLISHING UPDATED SEWER SERVICE CHARGES (OPERATION AND MAINTENANCE USER CHARGES)

WHEREAS, the Village of Red Hook owns and operates a publicly owned treatment works (POTW) and sewerage system serving properties within the Village sewer use area;

WHEREAS, Chapter 145 of the Code of the Village of Red Hook provides for the imposition, billing, and collection of sewer service charges, including charges based on “Benefit Units” (BU);

WHEREAS, General Municipal Law § 452 authorizes a village to establish and impose sewer rents by resolution, and provides that a resolution establishing and imposing sewer rents shall be adopted only after a public hearing upon five days’ public notice;

WHEREAS, the Board of Trustees has determined that it is necessary and in the public interest to increase sewer service charges to ensure adequate revenues for operation and maintenance (O&M) of the sewerage system;

WHEREAS, a public hearing was duly held by the Board of Trustees on ____________, 2026, after at least five (5) days’ public notice, at which time all persons wishing to be heard were heard;

NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the Village of Red Hook, New York, as follows:

1. Sewer Service Charge (O&M/User Charge). The sewer service charge for operation and maintenance is hereby established at $178.00 per Benefit Unit (BU) per quarter.

2. Effective Billing. The charge established in Section 1 shall first be applied beginning with the March 2026 billing (and each quarterly billing thereafter), unless and until amended by the Board of Trustees.

3. Definitions. For purposes of this Resolution, “Benefit Unit” (BU) shall have the meaning set forth in Chapter 145 of the Code of the Village of Red Hook and the Village’s adopted sewer billing policies and procedures.

4. Supersession of Prior Rates. All prior resolutions, rate schedules, and portions thereof that are inconsistent with this Resolution are hereby superseded to the extent of such inconsistency, effective as of the March 2026 billing.

5. Administration. The Village Treasurer/Clerk and appropriate Village staff are authorized and directed to take all actions necessary to implement this Resolution, including updating billing tables, notices, and utility billing statements.

6. Severability. If any clause, sentence, paragraph, section, or part of this Resolution shall be adjudged invalid by a court of competent jurisdiction, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, section, or part directly involved in the controversy.

7. Effective Date. This Resolution shall take effect immediately upon adoption.
