AGREEMENT BETWEEN THE VILLAGE OF RED HOOK AND THE RED HOOK CENTRAL SCHOOL DISTRICT 2025 – 2026 SCHOOL YEAR

THIS AGREEMENT, made the _____ day of____________, 2025, by and between the Village of Red Hook, Dutchess County, New York, a municipal corporation duly organized and existing by virtue of the Laws of the State of New York with its principal place of business located at 7467 South Broadway, Red Hook, New York, and the Red Hook Central School District, with offices located at 9 Mill Road, Red Hook, New York 12571.

WHEREAS, the Red Hook Central School District (RHCSD) has requested that the Village of Red Hook authorize the Red Hook Village Police Department (RHPD) to provide police protection by providing police officers to serve as School Resource Officers (SROs) at various schools within the RHCSD in accordance with the established SRO Duties, attached hereto and incorporated herein by reference, and continue to provide police services at other school functions as requested.

WHEREAS, the General Municipal Law § 119-o authorizes municipalities to enter into agreements that contain provisions relating to purchasing and making of contracts subject to general laws applicable to municipal corporations and school districts,

WHEREAS, Educational Law 2801-a Section 10 require schools to define the roles of security personnel and law enforcement who are deployed in the schools,

NOW THEREFORE, in consideration of the mutual promises as more fully set forth herein, it is agreed by the parties hereto as follows:

  1. The RHPD and RHCSD, to ensure an efficient and cohesive SRO program, will build a positive relationship between law enforcement, students, and school employees. The goal of the program is to reduce crime, create a safe school environment, and provide a law enforcement resource to school administrators, teachers, and students.

  2. The SROs act in accordance with the recommended TRIAD roles of law enforcement officer, teacher, and informal counselor/mentor but do not enforce school rules or policies or become involved with matters that are strictly school discipline issues. The SRO may intervene (to the extent allowable by law) in student/staff matters if the Superintendent (or designee) determine that there is an imminent threat to safety and/or a possible crime has been committed. Acting in loco parentis, the principal (or designee) will inform the SRO of suspected criminal behavior within a reasonable time frame.

  3. The day-to-day operation and administrative control of the SRO program will be the responsibility of the RHPD.

  4. The SRO position will be filled according to the RHPD selection process. The RHPD will make the final selection of any SRO, in consultation with the School District.

  5. The SRO position is considered a specialized assignment within the RHPD, requiring specialized training. It is the RHPD’s responsibility to ensure that officers are

adequately trained for the SRO assignment.

  1. It is the understanding of both the RHCSD and RHPD that confidentiality and a student’s right to privacy are of the utmost importance in the administration of these services. Therefore, student records shall be kept confidential in accordance with all applicable laws and professional standards.

  2. The RHPD will designate an officer to be a member of the RHCSD District and Building Level Safety Teams. Additionally, SROs will be included in lockdown drills and, to the greatest extent possible, planned safety drills.

  3. The SRO will not be involved in student searches unless support is requested by the Superintendent or designee. To the extent practicable, parents will be notified of police involvement in student matters. Any drug paraphernalia will be turned over to the SRO within a reasonable time frame.

  4. The RHCSD shall give at least forty-five (45) days advance notice of changes in the requested schedule or for any cancellation of additional police services and seven (7) days advance notice for changes of dates and times of police protection needed for additional police services at other school functions as requested.

  5. The assignment and supervision of the RHPD shall be determined by the Senior Ranking Officer of the RHPD or designee. Efforts will be made to provide the district with as much staffing consistency as possible. All police service must comply with the Fair Labor Standards Act and the current Village agreement with the UPSEU.

  6. The RHCSD will provide the SRO (and the Senior Ranking Officer of the RHPD) a standard daily schedule to be followed while on school grounds. It is understood certain circumstances may warrant a deviation from the assigned schedule.

  7. RHPD will provide two (2) SROs for the 180 days of the school year and will provide additional police services at other school functions as requested by those authorized in Section 16.

  8. The RHCSD shall reimburse the Village of Red Hook a total of $155,000 for the 2025-2026 School year for SRO services. An additional SRO or Police coverage for additional services at other school functions will be billed at the following rates:

  • i. 1[st] -3[rd] Yr Part Time Officer $45.50/hr ($68.25/hr OT)

  • ii. 4[th] -5[th] Yr Part Time Officer $48.50/hr ($72.25/hr OT)

  • iii. Full Time Officer $76.50/hr ($95.75/hr OT)

  • iv. Police Sergeant $93.00/hr ($115.00/hr OT)

  • v. Police Lieutenant $105.00/hr ($131.50/hr OT)

13a. The RHCSD shall reimburse the Village of Red Hook for additional

oversight/security services/phone calls/meetings by the Police Lieutenant not to exceed $25,000.

  1. The Village of Red Hook shall invoice the RHCSD for all police protection services monthly. For additional services, the invoice shall itemize the date, event, and hours worked. It is agreed that the RHCSD shall remit payment to the Village of Red Hook within thirty (30) days of receipt of invoice.

  2. In the event of a dispute regarding any payment under this Agreement, the disputing party shall notify the other party in writing within thirty (30) days of receipt of the invoice in question. The parties shall then attempt to resolve the dispute through good faith negotiations within thirty (30) days of such notice. If the dispute remains unresolved, the parties agree to submit the dispute to mediation before a mutually agreed-upon mediator prior to pursuing any other legal remedies.

  3. Any undisputed amounts not paid within thirty (30) days of the due date shall accrue interest at the rate of 1.5% per month until paid in full. The party responsible for the late payment shall also reimburse the other party of any costs incurred in collecting the overdue amounts, including reasonable attorney fees.

  4. The RHPD shall additionally provide the Superintendent of Schools with a monthly report of activities performed by officers while serving in the capacity of School Resource Office (SRO). The format of the abovementioned reports shall be determined jointly by the Superintendent and Senior Ranking Officer of the RHPD.

  5. The following individuals from the RHCSD are authorized to contact the RHPD to request and schedule additional police protection:

  • a. Superintendent of Schools (or designee)

  • b. Building Principals

  • c. District Athletic Director

  1. The Village of Red Hook shall indemnify, defend, and hold harmless the RHCSD from an against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with any negligent or willful misconduct by the Village of Red Hook or its employees, agents, or representatives in the performance of this Agreement. This indemnification shall include, but not be limited to, claims arising from third-party actions or omissions related to the services provided under this Agreement.

The RHCSD shall indemnify, defend, and hold harmless the Village of Red Hook from an against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with any negligent or willful misconduct by the RHCSD or its employees, agents, or representatives in the performance of this Agreement. This indemnification shall include, but not be limited to, claims arising from third-party actions or omissions related to the services provided under this Agreement.

  1. The terms of this agreement represent the final intent of the parties. Any modification, rescission, or waiver of the terms of this Agreement shall be effective

only if evidenced by a subsequent writing, which is executed and acknowledged by the parties with the same formalities accorded this basic Agreement.

  1. The Agreement shall be effective September 1, 2025, through June 30, 2026.
