RESOLUTION TO REQUEST NYSDOT ESTABLISH NO-PARKING ZONES AROUND THE CROSSWALK AT ROUTE 9 AND FRALEIGH STREET

WHEREAS, The Village of Red Hook, New York (hereinafter the “Village”) is committed to ensuring the safety and well-being of its residents, visitors, and commuters, and has previously taken action to address traffic issues within its jurisdiction; and

WHEREAS, the Village has engaged in broader traffic studies and passed local laws, such as the 2025 amendment to Chapter 190, "Vehicles and Traffic" of the Village Code, which specifically regulates traffic on S. Broadway and Fraleigh Street; and

WHEREAS, the Village of Red Hook Public Library is a central community institution, and the intersection of S. Broadway and Fraleigh Street is a high-traffic area, especially for pedestrians, school children, and families; and

WHEREAS, concerns have been raised by residents regarding specific safety hazards at this intersection, including that parked vehicles obstruct the line of sight for both drivers and pedestrians, creating a dangerous situation where a driver cannot see a pedestrian until they are directly in the crosswalk; and

WHEREAS, New York State Vehicle and Traffic Law (VTL) Section 1202 generally prohibits parking within 20 feet of a crosswalk at an intersection to ensure the safety of pedestrians and motorists; and

WHEREAS, despite this state law, vehicles are currently parking in and around the crosswalk area, which obstructs the line of sight for both drivers and pedestrians, creating a dangerous situation where a driver cannot see a pedestrian until they are directly in the crosswalk; and

WHEREAS, a formal engineering and traffic investigation is necessary to fully assess the conditions at this intersection and to determine what, if any, additional improvements are warranted to ensure the safety of all who use this area; and

WHEREAS, the New York State Department of Transportation (NYSDOT) has the authority and expertise to conduct such a study and to implement necessary improvements on state-owned roads;

NOW, THEREFORE, BE IT RESOLVED, that the Village of Red Hook Board of Trustees hereby formally requests that the New York State Department of Transportation's Region 8 Office conduct a comprehensive traffic and safety study of the intersection of S. Broadway (NYS Route 9) and Fraleigh Street; and

BE IT FURTHER RESOLVED, that the Village of Red Hook requests that NYSDOT establish and post 'No Parking Any Time' zones extending at least 20 feet on either side of the marked crosswalk at the intersection of S. Broadway and Fraleigh Street, to preserve pedestrian sightlines and safety; and

BE IT FURTHER RESOLVED, that the Village of Red Hook requests that NYSDOT's study consider potential additional safety improvements, including, but not limited to:

  • Upgraded, high-visibility crosswalk markings and signage.

  • Evaluation of current speed limits and potential for enhanced traffic calming measures.

  • Improved pavement markings to enhance the visibility of lanes and turning points.

BE IT FURTHER RESOLVED, that the Village Clerk is hereby directed to send a certified copy of this Resolution to the appropriate NYSDOT officials, including Regional Director James Rusak, PE (Acting) , Assistant to the Regional Director Lisa Weiss, RLA , and Regional Traffic Engineer Gerald Charleston, PE , as well as to the offices of Senator Michelle Hinchey , and Assemblymember Sarahana Shrestha , and Dutchess County Legislator Kristopher Munn , to enlist their support.

This resolution shall take effect immediately.
