VILLAGE OF RED HOOK ZONING BOARD OF APPEALS MEETING October 22, 2020 7:00 PM REMOTE MEETING VIA RINGCENTRAL

Present: Chair Erik Cuthell; Member Maarten Reilingh and Member William Noonan

Absent: Member David Javsicas

Resigned: Member Caroline Rider

Chair Erik Cuthell opened the October 22, 2020 ZBA Meeting at 7:08m.

Chair Cuthell informed tonight ’ s meeting is being held in accordance with NYS Executive Order 202.1 which Governs the Open Meetings Law and makes it possible for the applicant and public to continue the business of the Village. Tonight ’ s meeting is being held via Ringcentral and a transcript will be provided at a later date.

Chair Cuthell did a Roll Call for all Board Members present: Chair Cuthell – present Member Reilingh - present Member Noonan – present

Chair Cuthell announced that ZBA Member Caroline Rider has resigned and thanked Member Rider for her years of service with the ZBA.

Chair Cuthell announced there was a quorum for tonight ’ s meeting.

Acting Chair Cuthell made a motion to accept and approve the minutes of the ZBA dated September 24, 2020. Motion seconded by Member Noonan. All in favor.

AGENDA ITEM #1.

Robert Santini 86 Cambridge Drive Area Variance – Fence Tax Parcel ID 6262-13-233436 Applicant, Robert Santini present.

Chair Cuthell advised that the applicant is seeking relief from Section 200-16-E-(26)-C – and applicant is present for an already installed 8 foot in height fence.

Chair Cuthell said there were no issues from last month ’ s meeting except for seeking advice of Village Attorney Victoria Polidoro, and advised that all tests were completed.

Chair Cuthell said that the conditions are that the considerations of location and terrain for this R10,000 parcel applied to a unique group of properties in the Village and as such this application to increase the back rear yard fence from 6 feet to 8 feet is a reasonable request.

Chair Cuthell asked the Board for any further comment. Both members felt it was a reasonable request and all issues were covered.

Chair Cuthell made a motion to approve the Area Variance request for property located 86 Cambridge Drive for a fence going from 6 feet in height to 8 feet in height per Section 200-16-E-(25)-(c) of the Village of Red Hook Zoning Code. Motion seconded by Member Noonan. All in favor.

AGENDA ITEM #2.

Erica Schupp 88 Cambridge Drive Area Variance – Fence Tax Parcel ID 6272-13-244443

Chair Cuthell advised that the applicant was not present but that this Board could make their decision without her presence.

Chair Cuthell advised that this request was for a fence to go from 72 inches to 120 inches by adding lattice at the top of the fence. Chair Cuthell said all particulars were discussed at last month ’ s meeting and all tests were completed and no objection except to seek the advice of Village Attorney Victoria Polidoro.

Chair Cuthell said that the conditions are that the considerations of location and terrain for this R10,000 parcel applied to a unique group of properties in the Village and as such this application to increase the back rear yard fence from 6 feet to 10 feet is a reasonable request.

Chair Cuthell made a motion to approve the Area Variance request for property located 88 Cambridge Drive for a fence going from 6 feet in height to 10 feet in height per Section 200-16-E-(25)-(c) of the Village of Red Hook Zoning Code. Motion seconded by Member Reilingh. All in favor.

Chair Cuthell made a motion to close the October 22, 2020 ZBA Meeting at 7:15pm. Motion Seconded by Member Reilingh. All in favor.
