ZONING BOARD OF APPEALS MEETING

August 27, 2020

7:00 PM

REMOTE MEETING VIA RINGCENTRAL

Present: Chair Erik Cuthell; Member Caroline Rider, Member Maarten Reilingh, Member

William Noonan and Member David Javsicas

Chair Erik Cuthell opened the August 27, 2020 ZBA Meeting at 7:03pm.

Chair Cuthell informed tonight’s meeting is being held in accordance with NYS Executive

Order 202.1 which Governs the Open Meetings Law and makes it possible for the applicant and public to continue the business of the Village. Tonight’s meeting is being held via Ringcentral and a transcript will be provided at a later date.

Chair Cuthell did a Roll Call for all Board Members present:

Chair Cuthell stated that we have a quorum for tonight’s meeting.

Chair Cuthell welcomed new ZBA Board Member David Javsicas.

Acting Chair Cuthell made a motion to accept and approve the minutes of the ZBA dated

June 25, 2020, Motion seconded by Member Noonan. All in favor.

AGENDA ITEM #1.

Erica Schupp 88 Cambridge Drive Area Variance – Fence Tax Parcel ID 6262-13-244443

Applicant, Erica Scupp present.

Ms. Schupp advised the Board that she was present to request this area variance for reasons of security to break up her house in a residential district from the mobile home park behind her house which is a commercial district, and in addition that the mobile home park is about 2-3 feet higher than where her property sits so in order to have the added privacy, she had to add additional footage and only a portion was made that high. Ms. Schupp advised that just this week where the section is location that added height was not made a person was on the other side and she could see from persons waist up.

Chair Cuthell asked applicant if all of the 10 foot high stockade fencing has already been installed. Ms. Schupp said correct. Chair Cuthell said there is an additional lengthy run of standard 6 foot height and applicant’s intention is to add lattice above the stockade to bring to match the height of the 10 foot. Ms. Schupp said yes to give additional privacy. Chair Cuthell

asked applicant to bring a picture of proposed lattice to the next meeting. Ms. Schupp said she was thinking of using traditional lattice and not wood because the wood is too hard to maintain.

Ms. Schupp said she thinks it is a plastic vinyl and she would match the color of the fence as a natural tone. Ms. Schupp said she will present picture of the lattice.

Chair Cuthell asked the Board for any comments.

Member Rider asked if there needs to be an application for site plan.

Chair Cuthell asked applicant if she got a permit for the fence. Ms. Schupp advised she did not as she was unaware she needed a permit for a fence.

Secretary Hart advised this was a building permit process after approval and no site plan required.

Member Noonan asked about location of the fence. Chair Cuthell said it is the backyard on the lot line between the house on Cambridge and back end of the turn-around on Colburn in the Mobile Home Park - rear fence only – no side yard.

Chair Cuthell made a motion to classify the variance application of 88 Cambridge Drive listed under Tax Parcel ID 6272-13-244443 as a TYPE II Action whereby not requiring any further environmental review. Motion seconded by Member Rider. All in favor.

Chair Cuthell made a motion to schedule a public hearing for the variance application of

88 Cambridge Drive listed under Tax Parcel ID 6272-13-244443 for September 24, 2020 at 7:00pm. Motion seconded by Member Noonan. All in favor.

Secretary Hart advised applicants on public hearing notice process.

AGENDA ITEM #2.

Robert Santini 86 Cambridge Drive Area Variance – Fence Tax Parcel ID 6262-13-233436

Applicant, Robert Santini present.

Mr. Santini advised the Board that he replaced his fencing a few years back to add privacy to backyard from Mobile Home Park and Dunkin Donuts.

Chair Cuthell said after reviewing this application that the applicant has gone from a 6 foot height to an 8 foot height fence which is already installed and applicant is not asking to do anything else. Mr. Santini said correct. Member Rider said after looking at other property parcels it looks as though the applicant has partial side yard fencing. Mr. Santini said each neighbor has side yard. Chair Cuthell advised they are 6 foot in height and conforming. Mr. Santini said the neighbors are who installed the side yard fencing. Member Javsicas asked applicant’s proposal of 9 sections at 8 foot fencing; 3 sections at 8 foot fencing and one foot stone wall and asked if the stone wall was below the fence. Mr. Santini said when they installed

the fence the property was higher on the one side so to keep the height of the fence at the same level instead of dipping down he built the stone wall underneath. Member Rider said so that means in that area it would go up more than 8 feet. Mr. Santini said yes 8 1/2 to 9 feet.

Chair Cuthell made a motion to classify the variance application of 86 Cambridge Drive listed under Tax Parcel ID 6272-13-233436 as a TYPE II Action whereby not requiring any further environmental review. Motion seconded by Member Rider. All in favor.

Chair Cuthell made a motion to schedule a public hearing for the variance application of

86 Cambridge Drive listed under Tax Parcel ID 6272-13-233436 for September 24, 2020 at 7:00pm. Motion seconded by Member Javsicas. All in favor.

Chair Cuthell advised applicants they will need to reach out to Secretary Hart to obtain addresses for public hearing notice mailings and get proof of certified receipts returned to Secretary Hart prior to next ZBA meeting.

Chair Cuthell advised that he feels the Board will not require anything further from Mr. Santini for the next meeting and only require more information on the lattice from Ms. Schupp.

Chair Cutehll advised anyone present for public hearing will have the opportunity to speak and this Board will complete Area Variance Test Sheet/Requirements which consists of 5 questions.

Chair Cuthell made a motion to close the August 27, 2020 ZBA Meeting at 7:25pm.
